It is seen that the major emphasis is laid on tracing the events that occured between 12.00 hours(midnight) to 6.00 am on 15/16.5.2008 for detecting the person/s who killed Aarushi Talwar and the servant, Yam Prasad(indeed)Banjade alias Hemraj,on the basis of the scanty and meddled-with pieces of evidence gathered by the investigating authorities, but no breakthrough has been possible so far,due to the mysterious and secretive behaviour of Dr.Rajesh and MrsNupur Talwar and their other family members and associates too. Much circumstantial and suggestive evidence has been gathered but no clinching or confirmatory proof has been discovered so far to blame anybody squarely and conclusively for the murders. However, as CBI Director AP Saini says, ” The decisions in the Aarushi case may seem controversial but that is a call an investigating agency has to take, based on the available evidence.” Hence this effort to arrive at a clue, on the basis of available evidence, if possible.
The crucial sequence of the ghastly and murky events of that fateful night of the murders is supposed to have taken place BETWEEN 12.00(night)-1.00 a.m on 16/5/08 as per the Postmortem report. Before the P.m,the Noida police had estimated it tentatively as having occurred between 1.00-2.00pm).RajeshTalwar was working alone in Aarushi’s room from 11.15 -12.08 hrs( till after Midnight). The time of Aarushi’s death, in view of her gastric contents showing semidigested food, is estimated to be between 12-12.30am.
There is no mention of Nupur having returned to the room after she left it
at 11.15pm to go to sleep, till next morning at 6.01am, when Bharti,
their maid servant woke her up by knocking the door, as Hemraj did not open the door as usual.
Perhaps, Aarushi might have been killed around 12.00(Midnight), that is, soon after her boy friend Anmol Agarwal phoned her for the last time in vain.( May be he was phoning her repeatedly in despair, as she was in the process of breaking up with a boy, probably himself, as mentioned in her Canada Aunty’s recent report, through ‘ Toronto Star’). Before that,he had called her on the landline at about 11.30pm to tell her that he wanted to take her to a restaurant to decide a date for discussing her Birthday Plans.
It may have happened accidentally by Rajesh pushing her forcefully against the wall,or by hitting her with a golf club in a fit of anger, in a scuffle between Aarushi wanting to lift the phone and speak to her friend,and Rajesh, angrily trying to prevent her from going to pick up the landline phone to tell Anmol things that Rajesh did not want her to, and also to prevent her from promising to meet him at the restaurant that night, at that late hour, after 11.30 pm. I get the impression that though otherwise good natured, Aarushi had a streak of impulsiveness and obstinacy in her, as many single and pampered children have,which brought about clashes with her father and her consequent, tragic,untimely death !
(Rajesh may also be suspecting Anmol of making clandestine overtures to Aarushi, because of which he was so much against the boy for fear that the latter was spoiling his daughter. For,
the parents came to know that the boy not only met Aarushi outside school, but also used to come to their home in their absence,as stated by a person knowing the family,but theTalwar’s relatives NOW say for some reason,that Rajkumar, their family friends’ servant, had an eye on Aarushi instead, and used to come to their house in the afternoons, in her parents’ absence.That day, however, it turned out, as the maid servant Bharati said in the CBI Court, that the main door was Not locked from outside, but only bolted, and she could easily enter through it.
In another statement by an aquaintance, its said that the parents tried every way of persuading Aarushi to keep distance from ANMOL, by scolding and locking up her room at night,reasoning sweetly, and trying to win her over with costly presents like the camera but in vain. Instead, she quarrelled with her father by counterquestioning him about his ‘affair’ with Anita Durrani. This Anmol was phoning her frequently and pursuing her doggedly till the ‘last hour’of her life !Finally, Rajesh lost his temper and hit her hard. (So, rather than Hemraj or Rajkumar, it looks that ANMOL may have been the one on account of whom Aarushi lost her ‘anmol’ life).
Aarushi had another boy friend, Sankalp aka Sanky Arora,an ex-student of Delhi Public School, whose father was working with a Security firm, before Anmol, whom she had dropped for Anmol, but who was trying to make a comeback.This may have led to jealousy and rivalry between the two boys. However, they do not seem to have had anything to do with her murder. It has to be said in all fairness, and with sympathy for Aarushi, at this point, that she was a little more than a child in age, so she may not be changing her boyfriends with the deliberate intention of making them crazy and desperate after her, but it is because girls at that age are immature and unsure of their minds, because of which, they may be unsteady in their relations with boys. Her Mother, Nupur Talwar, in whom she used to confide about her boyfriends, should have guided her to be more discreet and keep the right distance from male friends, ESP. Servants, but she failed in her duty as a mother. May be she just took pride in the number of boys who were after her daughter.And after Aarushi’s murder, she is said to have remarked that Aarushi went the Lady Diana’s way!
Yet,for whatever reason, her parents are not naming either Sanky or Anmol as a suspect, though the latter had given an adverse statement to the police aboutRajesh Talwar and his strained relations with Aarushi on account of his closeness with Dr. Anita Durrani, and may be some more crucial points, close to hinting at Rajesh’s involvement in Aarushi’s murder, which have not been specified by the Police (on being confronted with which by the Noida Police, Rajesh Talwar is said to have broken down and made a confessIon to them. He however, withdrew it later before the CBI Court, saying that he made the confession under pressure by the Police). The Talwars are probably afraid of saying anything against Anmol, as it is obvious that he is a ‘ Man who Knows Too Much’ about their private family matters, and may reveal more dangerous information, if named as a suspect. Moreover, he may be the son of an influential person.Hence, they are not saying anything about them.
Nupur, her mother denies this statement of Anmol of the strained relations between Rajesh and Aarushi.She says that her own relations with the girl were like those between friends and that she used to even monitor her SMSs and eMail accounts. She said that she knew her daughter had a boyfriend, and another previous boyfriend whom she had ditched(probably named Sanky alias Sankalp,as gathered from her Orkut page), but who was trying to comeback .
Still, she might have noticed something untoward in her relationship with Anmol that day, because of which she and Rajesh started trying to distance them by seizing her cellphone.
She insists that the relations between Rajesh and Aarushi too, were nevertheless, quite cordial and like any other father-daughter relationship.
Charles Sobhraj, a convict himself in Jail, has opined that it looks like the work of a jealous or frustrated boy friend or rival lover, who must be someone known to and trusted by the girl.He says that the Police’s best hope would be if a person close to the ‘boyfriend murderer’, if so, who suspects something amiss, comes forward with the information. The Police have already interrogated Anmol Agarwal, but not the other past close friend of Aarushi,viz. one Sanky , a DPS dropout whom she has ditched – an ex Orkutian whom she had removed from her Orkut account list, from this angle.
Following the murder,Anmol has removed Aarushi’s name from his Orkut album and steered clear of the case, after the 10-hour long Police interrogation in his parents’ absence during which, much focus was on the 688phone calls between him and Aarushi, and her being closer to him than to her parents,confiding in him about all her family matters, during the last 45 days !
Therefore, if not taken already, and still possible, the fingerprints of ANMOL,and Sanky too should be taken for tallying with the ‘unidentified’ fingerprints and DNA obtained from samples in Talwar house.
Anmol had already informed the police about the strained relations between Aarushi and Rajesh on account of his supposed affair with Dr. Anita Durrani, as well as about Aarushi’s close relationship with Hemraj, to whom also she used to tell everything, even about the private matters of her parents. It is said that the servant also used to blackmail her about her friendship with Anmol. It is not known how Anmol felt about Hemraj.
ENTRANCES to Aarushi’s room:-
(1) Now, a doubt has been raised about how an outside killer, whosoever, let in by Aarushi or Hemraj could have left after locking the Main door ‘from within’,as Bharati,the maidservant of the house, who came to work at 6.00 am,and was the first person to come to that house on murder morning,said before the CBI Court, as on the night of the murder, there were only four persons in that house, including the two victims, besides the Talwar couple,which is taken to indicate that only the Talwars could be the killers.
(2) There is another way to approach Aarushi’s room, from the roof/terrace of the building, down the pipe to the balcony on the backside of Aarushi’s room, and in, through which Hemraj is said to have entered Aarushi’s room on murder night, as mentioned by one Akshay Anand (of You Bihar.com, Bihar Social Networking Online, who claims to know Shreya, Dinesh Talwar’s daughter) in one comment that Someone saw Hemraj going down towards her room from the terrace through the backside of the house on murder night, and phoned to Rajesh Talwar about it, due to which he was murdered.
(3) However, there is one more regular entrance to Hemraj’s room-besides the one from inside Talwar’s house, that is,by the way of the staircase,from where one can come and go out with ease, and lock the main door from outside.Krishna and Rajkumar, Hemraj’s friends, could have come and gone through that door. They may not have locked that door, but just closed it, which Bharati didn’t know as she did not check that entrance.
(4) It is also learnt that one door opening from Aarushi’s attached bathroom also opens directly into the Hall,and that, if that door was not latched from inside, anyone could enter her room through that even if the main door to her room was locked.It’s not known where the bathroom which Hemraj was using was situated,outside or inside the house in the servant’s room as an attached bathroom, and how close to Aarushi’s bathroom.
Still, the question would remain about Who cleaned and’dressed up’ Aarushi’s body and bed, and deleted the other proof of the crime, and Why?For no outsider would linger long at the site of his crime, just to clean and dress the crime scene,when it was known that the Talwars were in the house, and sleeping in the room next to Aarushi! Also, why would Rajesh Talwar show unwillingness to open the terrace room door, if he was not involved in the murders?
Now supposing that Krishna had committed the murders (which is possible because,having worked as Rajesh Talwar’s compounder and assistant in his Dental clinic, he must be familiar and experienced in the use of the surgical knife and other equipments), but acquitted even after his own confession, there must be some big person/s sheltering him, of whom Krishna is the tout.Who could it be? Retd.Dy SP KKGautam, who had taken the initiative to visit Rajesh Talwar’s house in his absence,trace and locate Hemraj on Dinesh Talwar’s request by getting the terrace opened on the second day of the murder, till which time, it was believed that Hemraj had killed Aarushi and run away? Or is it a CBI Officer known to Krishna, to whom he is supposed to have sent an SMS the day Before the murder? Or Dinesh Talwar?
For, though it was good that Hemraj’s body was found before the killer(whoever it be),got the chance to dislodge it from the terrace, and though( if Rajesh is the killer, and intended to dispose of the body later, he deserved to be exposed before he was able to do so),it is a bit strange that Dinesh,Rajesh’s own brother, brought about the complication of the case by first creating a telephonic loop between himself,his friend, Dr. Sushil Kumar Choudhary,the latter’s friend KKGautam, and ‘an unidentified number'( who?); then back in reverse order, on 16.5.08 AN,
and 17.5.08 forenoon, thereafter calling Gautam to Rajesh’s house in his absence,where KKG in turn, got the terrace opened in full gaze of of top police officers of Noida and journalists, with the comment that ” there was likely to be an interesting discovery”!
This led to the exposure of Hemraj’s body,and a total U-turn of the Aarushi- Hemraj double murder case, which, for one whole day,had remained on police records, as the case of only murder of Aarushi, supposedly at the hands of Hemraj, the missing servant.
This also shows that Dinesh Talwar probably knew or strongly suspected some known person to be the murderer, and where he had hidden Hemraj! Why did Dinesh not do this on the previous day itself in Rajesh’s presence, without involving Dr. Choudhary and KK Gautam, by persuading Rajesh to let the police open the terrace to look for any clue to Aarushi’s murder,then and there, before urging them to go out in search of Hemraj outside.
It is still A CRUCIAL QUESTION/ MYSTERY however, WHY RAJESH TALWAR WAS apparently RETICENT TO OPENING the TERRACE DOOR on the FIRST DAY OF the MURDER,ESP WHEN HEMRAJ WAS ‘MISSING’, when he should have thought of looking there first, before driving the police to search for him outside, if he had no hand in, or knowledge of the murder.
Nupur Talwar’s explanation was that the terrace door was locked from the previous day because painting work was going on in their block,and the workers were going up and using up their tank water, but they could not locate the next morning where they had kept the key, and also they did not know or imagine that Hemraj too may have been murdered!
However, on being shown the blood stains on the staircase and terrace door by friends Drs. Kochar and Varshney, who had visited the Talwar house on the morning of the murder,at least, Rajesh Talwar and Noida Police should have sensed something foul, and proceeded to open the door by breaking the lock, instead of wasting one more day searching for Hemraj outside.

it is mentioned in one para that the bunch of keys of the flat were found by Nupur on the following morning after the murder, that is,16.5.08 morning, on the bed in Hemraj’s room,and the keys of Aarushi’s bedroom were found on the floor of the living room. In a later para, it’s said that the terrace door lock had to be broken when the police came on 17.5.08,to open the door, as the keys to the terrace were still missing! (It is strange that only those keys were missing among all their keys! It is not known if the police took the finger prints on the keychain and other keys to know who might have taken those keys). It is also stated that the bunch of house keys was the only one they had,so it is not understood how and from where the keys reappeared as suddenly as they went missing earlier, and how the Talwars had got locked from outside, as they claimed to have been on the murder morning when their maidservant Bharati came for work.
Bharti told the CBI Court that after entering the house and seeing the dead body of Aarushi, she asked Nupur whether she should wash the dishes and vessels but Nupur said ‘ No’, so she went to work at other households. Why did Nupur not let her go in to clean the dishes? Was any proof or person remaining there that Nupur did not want the maid to see?No matter how unbiased one may try to be in our interpretation of the observations, one can’t help doubting that all this was done by Rajesh Talwar. It seems that the bunch of keys of the terrace was with Rajesh only, but before the police coming at 7.15am and asking for the terrace door keys, Rajesh took the keys of the terrace and hid them somewhere else, Whether he committed the murder/s or not, and himself dumped the body of Hemraj on the terrace or not, it is almost certain that Rajesh was probably knowing who the killer was, and that Hemraj’s body was on the terrace,as also where the terrace keys were, when the police came to his house on the morning of the murder and asked for the keys! He did not keep those keys in the bunch, so that the police had to break open the lock the next day to open the terrace!]
It is these little lapses that have made the Talwars’, ESP Rajesh’s behaviour seem abnormal, secretive and suspicious to many onlookers at that time itself, and the doubt was compounded and strengthened when Hemraj’s body was found in the same place, i.e on the terrace the next day, on the terrace door being opened by breaking the door lock by the police, and Rajesh and brother Dinesh expressing inability to recognize the body as that of their own servant, whom a friend of Hemraj’s identified immediately afterwards, and slipping out of the place hastily along with Nupur, who was sitting in the car with the ‘Asthikumbh’ to go to Hardwar for the immersion of Aarushi’s ashes, leaving the house to the mercy of the Police, to investigate and make out any conclusion about the double murder in their absence, as though Hemraj’s murder didn’t concern them.
The best part is that Dr.Kochar, that too a Dentist,was crossexamined by the Defense counsel of the Talwars to question ‘whether the stains he had seen on the staircase and terrace door of the Talwar house were of Human Blood or Red Paint’, taking cue from Nupur Talwar’s statement that painting was going on in that place till the day before; but would paint yield DNA on Forensic examination as bloodstains do?
Dr DINESH may also be aware of Aarushi’s close relations with the abovementioned boys, which is why he may have asked Dr, Dohre to remove mention of any sexual assault on Aarushi. That shows that the Talwars do not want the name of either Sanky or Anmol and Aarushi’s affairs with them to come out,for guarding their prestige, even though they may be knowing the true facts. Hence, the swapping of Aarushi’s vaginal swabs.
(It is not clear who replied supposedly as Rajesh Talwar on the murder night to the milkman that milk was not required that day, if the mobiles of both went missing soon after the murders).
However, there is one point which speaks more in favour of an insider having committed the murders,viz. the mobiles of both victims going missing immediately after murders,deletion of entries in Aarushi’s mobile and Camera, esp. deletion of Aarushi’s profiles from the social networking sites, with an effort to change the passwords of Rajesh and Aarushi, on or around 19.5.08, I.e. 3 days after the crime, and before the arrest of Rajesh Talwar on 23 May 2008, when the criminal, unless he is an insider,couldn’t have got the opportunity to tamper with the gadgets and evidence after the murders.These points bring the quest for the criminal to an insider’s work ,again and again.
Also, it was reported by Noida Police at the beginning of the investigation that Rajesh Talwar had initially broken down and confessed his guilt, on the Police confronting him with the information given to the by Aarushi’s 17 yr old boyfriend Anmol ( probably something,true or false,that Aarushi might have told him during their last talk on the Landline, between 11.00-11.30pm, after her mobile ‘stopped working’), while Krishna Thadarai,Rajesh’s compounder,also confessed about himself and Rajkumar, Rajesh’s business partner Durrani’s servant, having killed both Aarushi, on finding her door open on his visit to the Talwar house that night by gagging and hitting her on the head with a stick,and slitting her throat on her trying to resist Rajkumar’s molestation and shout,
and Hemraj too, as he panicked and threatened to call his master and mistress.
On the other hand,the second team of CBI says that the confession of Krishna,his Clinic Assistant, and Rajkumar, Talwar’s business partner’s domestic servant, may have been prompted by leading questions put to them during Narco Analysis by the first team and hence unreliable. Moreover, their confession is not corroborated by finding the fingerprints or DNA of any of the servants in the samples collected from the Talwar house, on Forensic examination.The question about the mix up of the pillowcases of Hemraj and Krishna has also been solved(correctly or incorrectly) and shown that the pillowcase supposed to have been found in Krishna’s room with Hemraj’s blood and DNA, was found in Hemraj’s room only.
Rajesh also withdrew his confession during the court trial, but then, what is the meaning of his initial confession? However, at the time of Rajesh’s arrest, the Inspector General of Police, Gurdarshan Singh, refuted this claim of the Noida Police about Rajesh’s confession, and said that Rajesh Talwar had not confessed,and that “No one initially confesses to his crime!”
The Defense counsel for Rajesh has pleaded that even if he might have confessed his guilt,it must have been under duress by the Noida Police.
As to their surmise about Rajesh having been infuriated by finding Aarushi in a compromising position with Hemraj, and his own affair with Anita Durrani being resented by Aarushi, being the motives of his crime, it is based on the statement of Krishna Thadarai, but no satisfactory explanation has been obtained about why Rajesh avoided the opening of his terrace door and pressurized the Noida Police to search outside his house for Hemraj on the first day of the murders if he had not committed the murders. Was he threatened of dire consequences by the murderer/s, if he made any reference to them, and suggested to put the blame for Aarushi’s murder on Hemraj and the other servants, to protect himself?
I don’t know how much truth is there in the general statement of the IG of Police, that
‘noone initially confesses his crime’, and suspect that both the Noida Police and the CBI were initially trying to protect Rajesh Talwar and put the blame for the murder on the servants Krishna and Rajkumar. Even the second team of CBI had submitted their closure report in December 2010 without recommending any punishment for the Talwars, and had only mentioned therein that they had named them as suspects for the crime on the basis of strong circumstantial evidence, but were nevertheless asking for closure of the case without proposing any penalty for them because of insufficient evidence! That way, they had solved their dilemma of blaming either Rajesh or the servants (who, it looks, are also being backed by some powerful people) by choosing the middle way out of calling their inquiry a ‘draw’, but the Talwars themselves made their position difficult by irking the CBI, by protesting against the closure of the case and asking for reopening and reinvestigation of the case!
Coming back to the events on the night of the murder, Rajesh was apparently actively busy at the computer from 11.15- 11.57pm, on 15.5.08 night,after Nupur put on the router at 11.00pm.and left the room at 11.15pm. He had sent one eMail at 11.37.54 and some more at 11.57pm. He had also spoken to someone from US at around 11.57pm. So if he had hit Aarushi, it must have occurred between 11.57pm and 12.08hrs on 15.5.08. The last timeAarushi was mentioned alive was at 11.15-11.30pm on 15.5.08 night,when Nupur saw her, and Anmol spoke to her last at about 11/11.30 PM. It tallies with the postmortem finding that Aarushi was killed between 12-1am,but it is difficult to be sure in respect of Hemraj, who was found one day later In a decomposed state due to lying for one full day on the terrace, in the hot summer of 2008.
This time tallies with that estimated by Dr. Dohre, of the Govt. Hospital, who did Aarushi’s Postmortem, on the basis of the presence of semidigested food in her stomach, and the onset of Rigor Mortis, but there would have been less accuracy in determining the exact time of death of Hemraj, due to reasons given above.
(The Talwars have given 2.00-2.30 a.m on 16/5/08 as the time of her death to the priest at Hardwar,at the time of immersion, even before the time of her death,i.e.12.00, midnight-
1.00 a.m as per Post Mortem report,became known to police,on basis not understood, as they claimed to have been sleeping at that time. It looks like Rajesh deliberately gave the time as 2.00 am as an approximate to convince the police that the murder had probably taken place WELL AFTER he went to sleep, instead of between 12.00-1.00am),though reports mention the time of Aarushi’ death as between 12.00pm of 15.5.08 to 1.00am on 16.5.08. However, it is not feasible for this to be the correct time of her death, for considering that Aarushi is said to have had her last meal at 10.00 PM, the food would have been totally digested by 2.00-2.30 PM, and not incompletely digested, as has been reported.Therefore,her death cannot have occurred so late in the night.
Aarushi might have been killed sometime during the approximately one hour,after Nupur left Aarushi’s room for the night to sleep,and12.15pm, till which time, Rajesh Talwar was very much awake, considering that he sent some eMails, at 11:37:54pm, to the American Academy Of Implant Dentistry, and some more at 11.57pm and had spoken to someone from US at 11.57pm, and was working in Aarushi’s room on her Internet till ‘at least’ 12.08 hrs(after midnight). That is What makes one doubt about the murders having been committed by Rajesh himself, or someone called in by, and with the knowledge of Rajesh Talwar,or perhaps by himself, without the help or knowledge of Nupur!
In fact, it is doubted that Rajesh was awake till 3.43am, the time upto which the Internet was noted to have been on, on 16.5.2008, after Rajesh is said to have finished working on it, i.e.
2.04- 3.43, including the time given by Rajesh Talwar as that of Aarushi’s death at Hardwar,viz 2.00/2.30am on 16.5.2008).Somebody put off the router at 3.43am on 16.5.08, but apparently ‘without noticing that Aarushi had been murdered’, or at least without raising an alarm!
Whatever it is, it could not have been possible for Hemraj or any outsider or servant suspect, whether Krishna or Rajkumar, to have come to Talwar house ,and raped or murdered Aarushi on his own, while Rajesh was up and awake. As such,the three glasses on the table in Hemraj’s room may have been merely preparation for a party for which no one turned up,and the signs of three people sitting on Hemraj’s bed, might be planted evidence or old marks.
It is reported that Hemraj served dinner to the Talwars at 9.30pm, after Rajesh returned home; Aarushi probably sat down to have her food subsequently, I.e. a bit later than the others, at about 9.45 pm, judging that Rajesh’s Driver saw her as already sitting at the dining table with her mother at 9.50pm; then Hemraj served himself at about 10.30 PM,but did not eat it as though ‘someone came and called him suddenly’, or was expected to come. However, no one was reported to have come to meet him either immediately,(or later, till Rajesh was awake and working, I.e.till 00.08am), otherwise he would have had his food.There was just 25 ml of liquid ( liquor)in his stomach, as seen on Postmortem.Then who would have come and killed him?
It is said by some that Krishna had come on 14.5.08 to give him a Khukri that Hemraj had asked for, as he feared for his life.If so, why would Krishna himself strike him with the Khukri? However, the possibility of Krishna having had a fight with him for not leaving the Talwar house job for the sake of their previous domestic help Visnu Thapa on the bidding of the latter, to whom they were all obliged for getting them jobs,cannot be denied. The murder of Hemraj at least, if not of Aarushi, could be because of that.
Krishna is said to have sent an SMS from his phone to the CBI Office number,on May 14,’08 for whatever reason, but CBI does not acknowledge receiving it.
One thing is noteworthy, that Hemraj was said to have been seen last by Umesh driver on 15.5.08 night at 9.50 PM, when he had come to the Talwar house to give the car keys and Rajesh Talwar’s bag, when he saw Aarushi at the dining table with her mother and Rajesh comings out from the inner room, but It has not been mentioned anywhere that Umesh ‘left’ the house immediately after that.
Hemraj had served dinner ( simple, light, vegetarian meal of okra( Bhindi)vegetable, pulses, rice and rotis- in common words, Sabzi, Dal, chawal,and Rotis)to the Talwars at 9.30pm,and afterwards he served food for himself at10.30pm, which remained uneaten for some reason.That is the last that we hear of Hemraj before his murder.
It seems to the police that Rajesh, who is supposed to have come home (with Nupur?) at 9.30pm,and gone out again soon after dinner, to return at 11.30pm, had actually not left the house, but had called Hemraj to go to the terrace, before Hemraj started his meal, i.e. after 10.30 pm,where Rajesh first tried to sort out matters by confronting him with the allegations of instigating his daughter against him and his family and social circle by telling her ‘tales about wife- swapping’ going on in their parties, and trying to make him confess and promise to refrain from gossiping about his family but,the talk did not work out as desired.So he decided to do away with the Gorkha (perhaps with the help of Umesh Driver),by hammering his head first with a hammer on the terrace, and then slitting his throat with a surgical knife that he carried in his pocket.Then he locked him up there,and told Umesh to go away after locking the main door from outside, in order to put the blame of the murder of Aarushi on Hemraj, i.e. if Aarushi’s murder was also a preplanned one.
That may be the reason why he gave her the camera to her in advance as a last effort to persuade her to stop bothering about and discussing her parents’ highly personal and private matters with outsiders.
The murders took place after Aarushi had her dinner, which she had from 9.45-10.10pm. It takes about 3hours to 5 hrs(for heavy meals) for the food to be predigested into a thick liquid’chyle’ in the stomach and go via the Pyloric Valve into the duodenum, (viz the part of intestine immediately after the stomach). The meal which the Talwars had that night, as mentioned above, did not have any heavy items, so full digestion of the food within her stomach would have been completed by 1.30- 2.00 am on 16.5.08).Hence, the finding of semi(half)digested food in her gastric contents indicates that Aarushi may have been killed between 12 to12.30pm, or soon after, thus leaving hardly any time for the servant suspects, Krishna and Rajkumar or anyone else, to go to the Talwar house and kill two people on that fatal night. However, someone could have come just after 12.30pm and done it.
According to a report published by Yahoo!India News,of the deposition of CBI Officer, AGL Kaul, before the CBI Court on 16.4.2013,stating his opinion that Rajesh and Nupur Talwar committed the double murder,the three servants Were at Talwar’s residence on the night of the murder, but that they don’t seem to have had anything to do with the murder!This doesn’t appear at all convincing!
Therefore, one way to determine the exact time of Aarushi’s Death, and identify her killer is to obtain information from the Central Forensic Science Lab,where Aarushi’s gastric contents were examined, about the exact stage of Digestion at which the Food Contents of Aarushi were found in her Gastric contents,i.e.whether in the earlier half part, or final stage, which is also one type of material, rather than circumstantial proof.
If the semidigested food contents were found to be in the MIDDLE stage of digestion, then it follows without doubt that Rajesh Talwar, who was in her room from11.30 to at least 12.10pm, must be the killer, for neither Hemraj nor Rajkumar, nor any of the other two servants could have entered Aarushi’s bedroom to rape and murder her while he was awake.And, as Hemraj is supposed by some investigators to have died only a short while( hardly half- hour) before or after Aarushi, he might have been killed around 1.00am.
According to the CBI Closure Report submitted to the CBI Court, Aarushi is supposed to have had her night meal between 9.50-10pm that night, according to the statement of Umesh Driver, that he saw her sitting at the dining table with her mother, when he went to their house and handed over Rajesh’s bag and car keys to Hemraj, who was serving food to the Talwars then, and that the parents came to Aarushi’s room after the meal,when she took some photos of herself and them at 10.10hrs as shown by the wall clock in one of the photographs.
As per the normally expected time of 3- 4hrs for completion of the process of digestion in the stomach, the food would have been half-, or two-thirds digested by 1+1/2- 2+1/2hrs after dinner, I.e. at 12.15/ 12.30 pm, till which time, Rajesh Talwar must have been awake; but, it the food contents were found in the LAST stage of digestion, the death of Aarushi can be estimated to have occurred After 12.30pm, in which case there is scope to consider the possibility of the crime having been committed by Hemraj,or an outsider( either the servants or anybody else.)
After returning from the terrace at about 11.00pm,Rajesh had complained of his laptop and router giving trouble, and asked Nupur to put on the router of Aarushi’s computer,which was in her room,so he was alone in the room with Aarushi, after Nupur went to sleep. Nupur went to Aarushi’s room around 11.00-11.15 PM,and put on the router, at which time, she saw Aarushi alive for the last time. After that, he could have murdered Aarushi too,in the same way as Hemraj, to make it look like somebody else’s work. Maybe, he even cleaned Aarushi and dressed up the scene at that time itself,because of which, he might have been awake till 3.43 PM instead of going to sleep just after midnight.
During that period, he (or whoever was the murderer) destroyed all the evidence he could think of- the entries in the Mobile phones of the victims and Aarushi’s camera and thought of ways to dispose off both mobile phones. Besides this, an effort was made by some ‘unidentified persons,’ on or after May 19,’08 (i.e 3 days after detection of Aarushi’s murder and 2 days after the Talwars’ Hardwar visit,as also just before their laptop and computer were seized by the Police Officer, (late)Jagjit Singh Mullick, and before Rajesh Talwar’s arrest on 23rd May,’08 ), to delete Aarushi’s profiles from the social networking sites and to change the passwords of Aarushi and Rajesh’s own,that casts doubt on an insider’s involvement, and strengthens the doubt of Honour Killing. However, why the effort to change Rajesh’s password only alongwith Aarushi’s,and why not of Nupur Talwar? That is why no matter how neutrally I try to think about this case, this doubt about Rajesh Talwar being the killer rather than Nupur or anyone else, keeps tugging at my mind! Probably it was to prevent his communications with Dr. Anita Durrani from coming before the public. However, the observation only shows that someone may have tampered with the Computer and Laptop for family honour, but it does not automatically Prove that the person who did it was also the killer of Aarushi and Hemraj.However, the doubt still remains, as the Laptop and computer were taken by the Police on19th May’08, Before Rajesh Talwar was arrested on 23rd May.
Who else could tamper with the gadgets before his arrest except his closest relatives like wife Nupur Talwar and his brother/sister in law, Vandana Talwar? The latter, incidentally, circulated an email some months back, to many people in Aarushi’s name and from her computer and email ID that “Parents are Innocent”, to look like her Dying Declaration, which means that she knew Aarushi’s email ID and perhaps her password too, and used it, though a dead person’s account is not supposed to be used by anyone else, but is meant to be closed down immediately after the death of its owner.
Krishna was said by his landlord and family to have been sleeping in his own house that night. If that is true, he could not have been the murderer or responsible for the deletions.
However,Driver Umesh Sharma,who must have driven Rajesh home, might have been still around and available, as also Vijay Mandal, who was probably sleeping in the garage of the building, to act as the accomplice for the murder, which now seems to be a planned,rather than an impulsively committed crime. For when the Noida Police raided the garage on May21,2008,accompanying journalists are said to have observed some foul smell in the garage during their raid.
It is now deserving of investigation where Rajesh had gone from 10.10 – 11. 00 p.m., and the addressees and contents of the emails made from Aarushi’s computer on 15.5.08 night, from 11.00-11.57 p.m., and what he was looking up on her Internet upto 12.08 that night, as well as why neither he, nor Nupur nor Aarushi responded to Anmol’s phone on their landline in the Talwar couple’s bedroom at 12.00(midnight), when at least Rajesh must be still awake ! Aarushi was habituated to chat with friends daily from 12.00-1.00am every night, but that night she spoke to no one either on mobile Phone or landline after 11/11.30pm. So it is possible that the murders may have been committed shortly after11.30pm, after Rajesh went to sleep; but if the crime was committed by outsiders, it might have been between 12.30at night and 1.00am, (I.e.either Before Rajesh went to sleep OR After he is supposed to have gone to sleep.)
Therefore, there is every reason to suspect that it was at the hands of Rajesh Talwar, at
around 15.5.08 midnight,that the murders took place, perhaps with the help of UmeshSharma, his driver,who was apparently the last person to visit and leave that house on 15th night, probably with the mobile phone of Aarushi,for disposing off that evidence, as the killer of Hemraj is also believed to have done, since the two phones went missing immediately after the murders.
Nupur is innocent, according to me, at least of the murder of Aarushi, but she only is inviting trouble for herself by straining herself to support Rajesh, whose position has been doubtful from the beginning !
( Actually, the fact that the last brief talk Aarushi had with her friend Anmol at 11.00 /11.30 PM on
15-5-08 night, was from the landline phone from Talwars’ bedroom, suggests that her mobile phone was taken away from her shortly after her last talk with him on that phone at about 9.10 PM itself.)
Therefore, it needs to be probed into ‘WHETHER Aarushi and Hemraj, who were killed around the same time ,WERE ALIVE at the time Rajesh finished working at the Internet’, I.e. AT 12.08-12.10 or so,’And left Aarushi’s room to go to his room to sleep’, as the time when Rajesh went to sleep partially coincides with the time of the double murder !
It also needs to be identified with whom the ‘ Partal Male DNA’ found on Aarushi’s pillow and the staircase leading to Talwar’s terrace matches, which does not seem to have been done conclusively yet. Lately, the CBI and Forensic officers claim that both the murders were committed in Aarushi’s room,on her bed,in which case the partial male DNA on Aarushi’s pillow should have been found to match with Hemraj’s DNA, but it is not found to be so.
It is mentioned by NDTV.com in their article, ‘ Who is Nupur Talwar’, that on 15-5-2008,” A little before midnight,(at 11.57 pm as per police records), Rajesh reportedly sent out emails from the computer in Aarushi’s room, and Mother and daughter chatted. Then they all went to sleep- ( must be Nupur first, around 11.15 pm. and Rajesh afterwards.) That night, Aarushi was murdered in her bed.
Her parents, who slept in the next room, say they heard nothing over the sound of the Air conditioner.”( Naturally, as the murders must have already taken place before Rajesh went to his bedroom;and Nupur, who says she retired for the night at 11.00- 11.15 PM, might have been heavily drugged, or persuaded to drink heavily by Rajesh before she slept, as he claims he himself was while going to sleep, to ensure that She wouldn’t get up till morning, so that he would have sufficient time to do all the ‘coverup’ to convince her and the others of his innocence,next morning!
Now, one more version is reported by Noida SP Mahesh Misra, that Rajesh Talwar stated to him on the morning of the murder,that he had lockedAarushi in her room from outside at11.30pm as usual ,on 15.5.08 night, but forgot to lock his own bedroom from inside, so that “it is possible that someone stole the key”(of Aarushi’s room) “from his room,”to go there ! Which servant would dare to do that? To enter the Lion’s Den and steal the key from under his nose, especially from a man of whom the previous domestic servantRaju,aka Nim/Min Raj Kaushal too is said to have been afraid,and also killed subsequently and mysteriously.
And then, what about the emails sent by him from Aarushi’s computer at 11.57pm,i.e about midnight?
He also denied knowing where the key was on that morning; it was later found in the lobby in front of Hemraj’s door, as if kept there by someone with a view to endorse the claim of the Talwars that Hemraj had killed Aarushi and run away! It is this sort of varying and incredible statements and behaviour of Rajesh that casts doubt on his bonafides ! ( Nupur Talwar, on the other hand, gave the police a different statement, that they forgot to remove and bring back the key of Aarushi’s room after locking her in, so that it had remained on the door).
What is strange is ‘how Hemraj did not shout or raise a loud cry of alarm on being accosted by the killer.’ Aarushi may have perhaps been asleep when attacked so that she succumbed before she got any chance to wake up and scream, seeing that she was killed in her bed. However, the blood of Hemraj was found on the staircase railing and door handle of the terrace, but not in his / Aarushi’s room,and bathroom, which suggests that he was attacked somewhere in the passage near the staircase or on the staircase, before reaching the terrace, for which he must be awake when attacked.Moreover, it is stated that his body was found to have strands of the assailant’s hair in his mouth,which means that he was not gagged at that time.Then, how is it that he did not shout loudly enough for the neighbours, esp.immediate neighbour Tandon to hear,or how Puneet Tandon didn’t hear(/ didn’t heed?) his cries, if the passage and staircase was common for both flats ?Besides, the blood in the palm imprint on the terrace wall has also been discovered to be that of Hemraj, forwhich Hemraj must be awake and in the upright position till he reached the terrace. That means that he was struck heavily and his throat slit to kill him, only after he was taken to the terrace by whoever was the killer, before which he was presumably hit but not mortally.He was not killed within the flat like Aarushi for no one to hear. (Was he really caught red handed after Aarushi’s murder, as the investigators had first supposed,and in a guilty conscious state of mind, because of which he did not or couldn’t open his mouth till taken to the terrace?)
The Talwars and Nupur’s Canada cousin, as well as Aarushi’sfriends however,refute the suspicion of any undue involvement between Hemraj and Aarushi.Nupur’s aunt says that Krishna Thadarai planted this idea, and that of an affair between Rajesh Talwar and Anita Durrani, his business partner,in everyone’s mind,because he was sore with Rajesh for having scolded him before patients in the Dentist’s clinic).
The actual ‘relationship’ seems to have been between Aarushi and Anmol- rather than with the servant Hemraj, who may have been only a close confidante – seeing that her parents took away her Mobile phone, so that she could talk to Anmol only on the landline in their presence,and only for 34 seconds, when he rang her up on 15.5.08 at 11.00/11.30 in the night, and did not lift the LL phone at 12.00 though the ringer was on and the phone rang, as they may be thinking that the boy was having a bad influence on the girl.)
There is another report, of Arun Kumar, who led the first CBI Team, which states that probably, on seeing the door of Aarushi’s room open, the servant suspects, who had come to Talwar’s house at a late hour on the murder night,and taken liquor,entered her room with the intention of raping Aarushi, but on her screaming and resisting their advances,Rajkumar, who took the lead, became aggressive,and hit her on her head after gagging her,upon which Hemraj got scared that her
parents might wake up and intervened to stop him. So they first gagged him too,then took him to the terrace and killed him by hitting him and slitting his room with a Khukri. Thereafter, they locked the terrace and killed Aarushi in the same way. However, a question has been raised about how her parents did not wake up by her cries,though her door was open. It is also not clear whether or not they left her in a conscious or unconscious state, when they went up to the terrace with Hemraj, but she must have become unconscious, or she would have been able to wake up her parents before the servants came down to get at her again.
The fact that there is a doubt about whether she screamed at all( though according to the statement of Rajesh Talwar, one reason for their not having heard Aarushi’s screams was that ‘she had a sore throat that day’because of which ‘she may Not have been able to raise her voice to scream’), indicates that the assailant and killer was not Rajkumar, but someone close to her,whom she knew and trusted, and did not expect to be mishandled or harmed by.
Her mother was sleeping.There were two men in the house whom she trusted- Hemraj and her father.Out of these, Hemraj was in acute fear for his life, so even under the influence of liquor
(about which there are two statements,one being that of his Nepali friends who said Hemraj was a teetotaller), it is not conceivable that he would take the foolish risk of going to her room at night for sex,when her parents were in the next room, and ESP as he could get a sufficient chance to be alone with her during the daytime, when her parents were out at work.
On 15.5.08 afternoon itself, it is learnt that they were alone together in the house from 4pm,
after Nupur went to work,upto 7.30pm, when Nupur returned home (or 9.30pm,with Rajesh,according to some other reports). Still, in the video’ India TV special on Aarushi murder’ on you Tube, they both don’t seem to have been upto anything wrong! If Hemraj wanted to take advantage of Aarushi, he could have done it that afternoon, when Aarushi and the proper solitude were both available to him in the house for that. Why would he wait till the night, when her parents would be at home?A person who is mortally afraid of danger to his life is not likely to behave in such a dare-devil way, ESP When there was a better occasion available to him earlier the same day to ‘have the cake and eat it too’!
Her not screaming at the time of murder may also mean that she was killed while asleep,or gagged. If asleep,it would suggest that the assailant had come not so much for sex, but with the sole intention of taking her life, for whatever reason;otherwise, she would have woken up on being molested first, and raised a cry of alarm, or made some effort to wake up her parents/ mother.
(However, it is worth noting that under the Narco and other tests, Krishna mentioned his having ‘witnessed’ Rajkumar, Durrani’s servant molesting and killing Aarushi;as wellas Rajkumar, with Vijay Mandal, Neighbour Tandon’s servant, also killing Hemraj, who, they thought would expose them. Surprisingly,none of them told the CBI investigators that Rajesh Talwar killed Aarushi. If Krishna could defame Rajesh by spreading tales about the clandestine goings- on in his house, he would have revealed the fact of Talwar killing his daughter if the murder had occured in his presence.
Instead, in one report, Rajesh himself is said to have broken down and made that confession before the police soon after his arrest !The reason given by him for that is not clear. Probably it was to the effect that he got angry with Aarushi and inadvertantly pushed or knocked her against the wall, but that he didn’t know who killed Hemraj subsequently.However, he denied his guilt later in the CBI Court).
Perhaps, it may have really started as a usual quarrel between the father and daughter, in the process of which, he lost selfcontrol and inadvertantly banged Aarushi’s head against the wall without meaning to kill her, but when he saw that she had succumbed, he became panicky and sought to save himself of the legal consequenses of Aarushi’s death, as well as its repercussions on Nupur’s feelings towards him, by killing and hiding Hemraj on the terrace with the idea of disposing of him later,and slitting his throat as also that of the practically dead Aarushi to make it appear as somebody else’s work.Thus,Aarushi’s death is believed by some to be a crime of passion, due to a sudden impulse and anger, hence unplanned and accidental, but Hemraj’s was a deliberate and well planned, cold blooded murder !
This tallies with the statement given by Aarushi’s maternal uncle to the investigating agency,in relation to the case, that Aarushi was beaten that night in her home,the reason for which has not been revealed.
Further,It was said by the Talwars that the main door to their Flat was found locked from outside on the morning of 16.5.08,because of which, Nupur Talwar threw the keys down from the balcony on the backside of Aarushi’s room to Bharati, their maid servant, who was the first to come to their house on 16.5.08 morning, to open the door,but the same maid told the CBI Court that on going up to the door with the keys,she found that it was not locked from outside, only latched!
Then, why did Nupur send her down? For giving some finishing touches to the Dressing up of the murder scene? She also asked the maid whether she had gone up the stairs to Hemraj’s room, which the maid said she hadn’t, so it’s possible that the independent door might have been closed without locking from within, if the killer had made his way out through that door.
The CBI Report has stated that Raj Kumar, the servant of Talwar’s business partner and neighbour, had hidden and later disposed off the phones,but it has not been possible to prove that he had come to Talwar’s house that night. It may be that the phones were given to him by someone else e.g. Krishna Thadarai, the Compounder, who is suspected of having received Nupur’s call on that phone on 16-5-08 morning in the vicinity of Talwar’s house, who, in turn, may have got them through Driver Umesh or from Rajesh directly.
It is not clear who is behind the deportation of Aarushi’s mobile to Bulandshahar and Hemraj’s to Nithari /Punjab. About Aarushi’s phone, it is said that it was found on a ‘kacha’ road in the Sadarpur area of Noida, 15/20 days after the phones went missing, may be by that woman named Kusum, who picked it up, and after keeping it with herself for some time, gave it to her brother in Bulandshahar. By that time, it’s memory was wiped clean.
About Umesh Sharma, he is the one who is said to have taken the bloodstained mattress and bedsheet of Aarushi ,and dumped it onto the neighbour’s terrace on 16/5/08,as Rajesh Talwar’s terrace door was locked, as also cleaned and washed the floor and walls of the room,with the help of Vikas Sethi, Rajesh Talwar ‘s Clinic Manager,after her body was taken away for cremation,’with police permission,’according to their statement.It is Strange that the Noida police gave such permission on the very first day of the murder !
It is said that Umesh Sharma had reported late for duty on that morning at 10.00am and that both Rajesh and Nupur,who had not really cried to then, began to cry on seeing him,which is mysterious,and suggests that Umesh may be an accomplice with the Talwars in the crime, or at least knew some bitter secret.
It is reported that Umesh Sharma was taken by the CBI officers soon after the crime to the HDFC Bank branch, where the Talwars have an account, and it was found that Nupur had drawn Rs.26000/- from there recently for purchase of surgical equipment.
Rajesh and Nupur however claim that the double murders have been committed by someone else,probably Krishna,his compounder,in whose room a pillowcover stained with the blood of Hemraj was found,who they said, might have got into the house with the help of Hemraj(who had not eaten that night, as though waiting for somebody ),helped himself to the Whisky in the house, then entered Aarushi’s room, the door of which was open that night, and killed Aarushi and Hemraj , who triedto prevent the attack on Aarushi. The police who interrogated them said that Krishna was sore with Rajesh because the latter had scolded him sternly for making a wrong dental cast, so he had a motive of revenge for the assault on Aarushi.Thus,the Talwars say that they are being falsely implicated in it. The CBI believes that the finding of a bloodstained pillow in Krishna’s room is an erroneous finding due to a ‘mix-up’ on account of a spelling mistake in the report of CDFD( Centre for DNA Fingerprinting and Diagnostics),Hyderabad !This point needs to be investigated more deeply than has been done so far.
There is a report that Hemraj had approached a local social worker four days before the murder in a very frightened state, as though fearing for his life, but it is not clear of Whom. His wife has alleged that 15 days before his death, he had phoned to her, when he had expressed his fear of Rajesh Talwar, may be because the master threatened him of dire consequences if he continued to peep into the interior matters of the master and his family, and gossiped about them to Aarushi and outsiders.What is not understood in that case is, if he was afraid of Rajesh, why he did not leave the job at his place at once. Rajesh too did not sack him, though he might have scolded him for being too inquisitive.Hemraj could not have been afraid of Krishna, as the latter was friendly with him and confided in him about his resentment against Rajesh Talwar. He even asked Krishna to get him a Khukri, which Nepali men keep for their protection, which Krishna brought and gave him on 14th May 2008,I.e. the day just before his murder. Then,of whom else could he have been afraid of?Perhaps, of Driver Umesh Sharma, who was Rajesh Talwar’s confidant, who appears to have been keeping a watch over him and Krishna, as also their conversations, and who is said to have been the last person to visit Talwar’s house on murder night.
Or of Vijay Mandal aka Shambhu, neighbour Puneet Tandon’s servant,staying in the same block, though there is no apparent reason for him fearing either Shambhu or even Rajkumar, Durrani’s servant, unless it has anything to do with Rajkumar’s (and may be Shambhu’s?)lust for Aarushi.Still, that is a mystery.
As to all the interactions of the parents with the girl after 11.00p.m that night,as claimed by them, they may as well be fabricated statements of theirs without any concrete evidence, as for example, their giving the camera to her at night after dinner in her room and her clicking 28photos of them with it, out of which 23 (3/4 th) snaps have been strangely deleted and only 5 photos, mostly of Aarushi alone are seen now. Where did all the other snaps of Rajesh and NupurTalwar go,why and how?
As said before,it is believed that there has been an attempt to change the passwords of Aarushi and Rajesh from their computers by some unidentified people after May 19,2008. What could be the motive behind this but to conceal or distort some facts , and who but Rajesh and Nupur, and/Dinesh Talwar and his wife Vandana Talwar can be suspected of having done this?
To sum up, if the deaths can be proved to have occurred before 12.30pm on that day, it is almost 100%certain that Rajesh Talwar is the culprit,but if it is likely to have happened much after 12.30pm,i.e around 1.00am, there is possibility of an outsider having committed the murders-whether one or more of the servants or one of Aarushi’s friends. As said before, a simple way of deciding whether the deaths, esp that of Aarushi, took place around 11.30-12.00pm or 1.00am, is to find out at what stage of digestion the food contents in Aarushi’s stomach were found.
If in the early/ middle stage of digestion,the chances are of Rajesh having committed the crime for whatever reason.But, if they are in an advanced state of ‘ Pre Digestion’, as the initial process of digestion within the stomach is called, then there is possibility of another person – an outsider having got into Talwar’s house secretly that night,and done it. For that, back reference should be made to the Forensic Science Police, where Aarushi’s stomach contents were examined.Dr. Dohre, who did Aarushi’s postmortem, may also be able to tell, if he had also examined her gastric contents.
One more observation mentioned in he Post MortemReport deserves discussion, viz. the wide open Vaginal Orifice seen in Aarushi’s body, which is not a natural condition.Dr. Dohare stated before the CBI Court that such a state occurs when the body is tampered with at the time when ‘Rigor Mortis’, I.e. stiffening of the body after death has set in,or is about to set in. This process starts about 2- 4 hours after death, and reaches its maximum by 12 hours, after which it remains stable upto about another 24 hours,I.e. the second day of death, and then wanes off gradually as decaying and putrefaction of the body begins to become complete in 36-48 hrs.
Dr. Dohre had also expressed doubt about the ‘ White Discharge’ like substance seen on one side of the vaginal wall and on the mouth of the cervix, that it looked like some white substance introduced within from outside, rather than the natural discharge in young girls’ bodies. It could not be said with certainty to be Semen as there were no sperms found but they may have been washed out during the cleaning of the private parts,that is supposed to have been done on Aarushi after her death. Rape could not be proved as there was no sign of force or resistance, but there was an old tear of the hymen, with fimbriation, which indicated previous sexual exposure. Aarushi is said to have died between 12.00pm-1.00am on 16.5.08. so the Rigor Mortis must have started at about 3.00- 3.30am, in the middle of that night. It is not likely that an outsider would linger on in the house till then, for 3 hours after the murder to meddle with the body. So this tampering with Aarushi’s body seems to have been done by someone within the house, for reasons best known to the person who did it – who was most likely the one who came to Aarushi’s room and put off the router at 3.43 am. He/she may be the killer, considering the general rule that it is the usual tendency of a criminal to revisit the site of his crime. (The Rigor Mortis must have reached its maximum around 12.00- 12.30pm., that is, when the Post Mortem was started).
It is trusted and hoped , in spite of doubts arising from the above observations and considerations, that this is not really a case of incest,and,or murder,to hide the ghastly assault, as some readers suspect! Normally, no one does such a thing with an only daughter,that too, the only child, who has been born after 5 years of marriage, with special treatment, but the nature of some people is very complex, and what prompts them to commit such a crime is difficult to fathom!
Who knows, Aarushi may have told Anmol about any undue intimacy that Hemraj(or Rajesh?)may have had or tried to have with her already, and her relations with Hemraj being found out by Rajesh, for which he might have threatened Hemraj and her with death next time he caught them red handed.
Or else, Anmol might have come to the doorstep of Talwar on failure to get response from Aarushi just after 12.30p.m, and finding the main Iron door just latched and not locked, enteree the house through the door of Hemraj’s room,which may have been kept open that night by Hemraj for his friends, and was about to enter Aarushi’s room when he stopped seeing Rajesh there. So he hid behind the door, saw Rajesh strking Hemraj and Aarushi,and slipped away as stealthily as he had come. If so, he must have told this to the police.It is with such confrontation that Rajesh may have confessed to his guilt to the Police in the beginning, when He may be in a vulnerable state of mind. Otherwise, just being confronted with his affair with Mrs.Durrani,or his displeasure at his daughter’s growing intimacy with their servant,alone does not seem enough evidence to make him break down and confess to murder of the two !
Dr.Naresh Raj, who did the PM of Hemraj, stated in the court recently that the private parts-penis of Hemraj was swollen, which indicates that he may have just had sex,or about to have sex (or in the midst of it?),when he was killed, which may have provoked Rajesh Talwar to kill him, and Aarushi may also have been hit accidentally or impulsively in the shock and anger of the moment.
(It may be to cover up the sexual activity that the cleaning of Aarushi’s private parts, request to Dr. Dohre, who did Aarushi’s PM, to withhold any finding of rape(statutory?considering that there was no evidence of force on Aarushi’s body,suggesting consensual sex),changing of vaginal swabs was done, and Hemraj’s body was hidden on the terrace. One thing needs to be ascertained that she was not given drugs or put to sleep by chloroform before any sexual assault on her).
However, I don’t understand how the doctor could differentiate the swelling and reddishness of the penis of Hemraj, which he ascribes to sex or arousal at death, from the bloating and superimposed discolouration that had spread over the body due to putrefaction.Did he find any other evidence like the pubic hair or blood of Aarushi on Hemraj’s private parts?(The same proof could have been observed on Aarushi’s body if it hadn’t been cleaned and disposed off quickly, which may be the very reason for the hurry! ) Perhaps,the tautness and enlargement of the organ as well as its erection, which may have been retained as such during the Rigor Mortis, may not have subsided by then, as the total period that elapsed after the supposed time of death (0.00-1.00am),16.5.08 to the time of finding his body,at 10.00am on 17.5.08, was about 34 hrs,while the period of Rigor Mortis is generally supposed to last upto 36- 48 hrs, before it starts subsiding with the onset of decomposition.And it is those parts on the lower side of the supine body that begin to decay earlier. So it may be that the decomposition process may not be complete,and may not have reached Hemraj’s genitals by the time the body was discovered.
Yet, one more thing which the police must or should have observed is the state of Hemraj’s pant- was it on, and if so,was it fastened and in order, or unfastened and come down a little like Aarushi’s pyjama and underwear?In one shot in the video’India TV Special on Aarushi Murder’, in which the bedsheet covering him has been lifted to expose the lower part of his body from waist downwards, his dress appears to be in order,but his underwear is seen to be lying by his side on the terrace. If he was having,or about to have sex with Aarushi, it would be in her or his bedroom, probably in hers, as the walls and bed of her room showed blood, not his.So the underwear would be expected to be found there.However, supposing the Talwars had removed it from there, and tidied his dress,to avoid embarrassment, in case of his body found by police and neighbours, they could have thrown his u/w in his room, which is on the way,while taking him to the terrace, instead of taking it along with his body to throw it on the terrace by his side, where also, it gives rise to speculations about whether he may have been engaged in sex with Aarushi just before his murder or not. This consideration, along with the view of Hemraj’s body,properly dressed,in the video,makes one wonder if the u/w too is ‘planted evidence’,to divert attention from the actual assailant! So, just as the other clothes on Hemraj’s body have been verified as his, it should be verified that the underwear, lying by his side is his, and not belonging to any of the servants or
Friends of Aarushi.
The body of Hemraj, which was found at 10.30 am. next day, on 17.5.08, was in a decaying and putrefied condition, so his murder might have taken place about 36 hours before, I.e. at about 10.30 PM on 15.5.08 night, but it is possible that the murder was committed later, and that the body putrefied earlier because of lying under the hot , blazing summer sun on the terrace.Also, there is supposed to have been an interval of just half an hour between the two murders, so it is quite possible that Hemraj too may have died somewhere between 12.00pm and 1.00am, 16.5.08, as per the P.M report, at or after 12.30pm, after Rajesh Talwar retired to his bedroom. If the killer had been able to dispose of the body immediately, he would have done so, but because the murder was committed at night, it may not have been possible to shift him from there right away, which is the reason why the terrace was locked for the first time that night.
Despite the various possibilities in this case, I’ve become convinced about one thing,that Anmol may or may not have killed Aarushi, but his intimate friendship with Aarushi, phoning and visiting her at late and odd hours, and Aarushi’s closeness with him, more than with her parents, and habit of telling him and Hemraj everything-including the private and delicate matters of the family, has played an important and pivotal part in precipitating this outcome because of Rajesh Talwar becoming progressively more and more prejudiced towards both of them and disapproving of their ‘intimate friendship’, and finally impelled to strike her fatally. A report that Aarushi was intending to meet him and show him all the’interesting’ family photos to Anmol that night may have been the ‘last straw’! As to why he/Nupur may have examined and washed her private parts around 3.30-4.00am may be to find out whether she had sex with him and was pregnant, and washed her parts to wipe out any signs of it before the body going for P.M.
About why he got Hemraj murdered may be to eliminate him as a witness of the murder of Aarushi(which he may have seen because of Aarushi’s screaming before her head banged against the wall), and also of other private matters of the family, which he told Aarushi and outsiders.
Still, my contemplation about the Events leading to the murders leads me to discuss the other following possibilities, besides the ones mentioned above :-
A) PHOTOGRAPHS :
If my memory about the Reports ,or if the reports themselves,related to the camera are correct,it is supposed to have been delivered at their residence the same (15th) morning at 10.00 a.m by courier, as per the information on one blog that I came across,so that it might have been seen and used by Aarushi after her return from school at lunchtime itself.Incidentally, she was at her home that afternoon instead of going to her grandparents’ place after school in the afternoons as she used to do on other days, as also Hemraj who had not gone to the Talwar’s clinic that afternoon,saying that Nupur Talwar told him to stay at home to look after Aarushi.
It is stated in someone’s blog that Aarushi had taken photographs of her Parents’ wife-swapping parties on her camera -maybe from the photos in her father’s collection,and wanted to show the same to her friend Anmol that night.
So, may be the parents,on learning about it somehow, went to her room that night at about 10.10pm(when Aarushi was still taking some snaps with it,and showing them secretly to Hemraj while sitting huddled to him), Not to Give, but to Take back that camera from her,before she exhibited those photographs to all and sundry,and ‘Washed their Dirty Linen in Public’. Aarushi may have refused to give the camera back so that a scuffle ensued between her and them who tried to take it from her by force.
Ultimately,things may have come to a point where Aarushi’s obstinacy made Rajesh so exasperated and desperate that he brought out , and hit her with ,his golfstick which was in Hemraj’s room,to make her release the camera . Unfortunately,the blow proved to be mortal and
Aarushi sank under it. Rajesh must be also suspecting Hemraj ,who knew everything about the parties and ‘get-togethers’, of instigating his daughter againt him, so he hit Hemraj,who was trying to make a discreet retreat from the scene, hard on the back of his head,just as he reached his room, and brought him down too.
After this, Rajesh could not see any other alternative but to finish both of them for sure. So he first dragged Hemraj out of the house with great caution and slit his throat with his surgical knife, and surgical gloves,on, or on the way to the terrace, after which he told his driver and compounder to wear gloves and shift Hemraj to the far end of the terrace, near the dividing wall between his and the neighbour’s terrace.This might be the reason that no signs of Hemraj’s blood were found inside Rajesh’s flat, either in Aarushi’s room, or his own, but on the way to the terrace,where anybody could be held for his murder.
Thereafter,he slit the throat of Aarushi also and dishevelled or ‘dressed’ her clothing, to create the impression that some outsider had assaulted Aarushi alongwith Hemraj ,or fought llwith him over Aarushi, then killed both the persons and gone away, throwing the underwear on the terrace and locking the main door from outside. The door might have been closed by Rajesh Talwar himself or by his driver.
(By the way, Nupur has pleaded that she had gone to sleep at 11.00 p.m that night after putting on the Router of the computer in Aarushi’s room,so she doesn’t know what happened thereafter.)
As regards the cellphones of both the victims, the same may have been entrusted either to his driver or compounder for disposal,and the weapon- the ‘khukri’,must have been taken away by Krishna, the compounder.
(According to this supposition,there is no explanation for the Post Mortem finding of ‘extraordinary vaginal orifice dilatation’;but then, that finding itself has been challenged as being an afterthought ,except for the mention of ‘a whitish discharge in the vagina on one side of the wall’ in the P.M. Report,and a later addition by the doctor who did the P.M.)
Just recently, I have read a report of 16.4.2013, that CBI Officer A GL Kaul has stated before the CBI Court that the 3 servants Were in the Talwar house,on the murder night ( though at what time they came there is not exactly known), but Kaul has added ‘naively’ that the helps (whom he seems to regard as Insiders) do not appear to have had ‘anything to do with the murders’!
It is also learnt that during Narco tests, Krishna and the other servants confessed to have gone to the Talwars’ house at a late hour on murder night, and they mentioned particular Nepali songs playing on a Nepali TV channel, run by Journalist- Producer Nalini Singh, while they were in Hemraj’s room.This was confirmed by contacting Nalini Singh, and she affirmed that the songs mentioned by the servants HAD been played among others in the program on that channel that night! From this information, the time of the servants arrival and being in the Talwars’ house can be deduced, as from 11.45 for 1/2-1 hr.
In that case, one reason why the Talwars may not have known when they came and killed Aarushi and Hemraj,i.e. if they have not committed the murders themselves, could be because they were not in the house then, despite the Talwars’ denial of having gone out that night. They may not have gone to a party in a hotel,for which some rooms were booked,as was said earlier, as the CBI has verified that personally, but that does not rule out the possibility of their having gone somewhere else, like Night show of a Film, for which they may have left the house at around12.20/.30at night, after Rajesh finished working at the Internet12.08) without switching off the Router or locking Aarushi’s bedroom door,and may have returned around 3.30/.40am, after which, they may have switched off the router without putting on the light in Aarushi’s room, due to which they did not notice the terrible spectacle of their daughter’s murdered body there. Or perhaps, the Router might have stopped on its own, as they say.
This theory would answer a lot of questions, if the Talwars confess to their having gone out of their house at that time, which they’re not doing for fear of their earning a bad name for themselves as irresponsible parents, at least indirectly responsible for their daughter’s murder, if not directly! Or, as said in one report, It may be that they do not wish to reveal where they had been at that hour, and for what purpose, for whatever reason.
B) The POSTMORTEM REPORT of Aarushi:
The PM report is quite confusing as it does not give any confirmation of recent rape or sex by force, but at the same time, mentions that there is ‘extraordinary dilatation of the vaginal opening’ which the doctor says may be due to some manipulation to open the vaginal orifice after Aarushi’s death,around the time when Rigor Mortis was about to set in, and a whitish substance inside on one side of the vaginal wall, but ‘no sperms’, as well as an ‘Old tear of the hymen and fimbriation.’ However, though this report,if taken for its face value, does not suggest recent sex or rape,( though it is possible that Aarushi might have been drugged with an anaesthetic like chloroform or rendered unconscious by the hitting on the head with a golf stick or hammer,due to which she would not have been able to put up any resistance), it does indicate longstanding habituation to sex ,consensual or forcible, with whomsoever,either Anmol , or Hemraj.
The whitish discharge may be Aarushi’s own vaginal leucorrhoec secretion. Or, it could be due to the dried remains of the soap water used for douching out her private parts,in accordance to the opinion expressed by Dr. Dohre, who did Aarushi’s postmortem, that the white fluid seemed to have been introduced into the vaginal canal from outside. Since no sperms are reported to be present, the fluid cannot be said to be semen, unless it is assumed that the sperms, if any, have disappeared due to the washing of Aarushi’s private parts. According to this supposition, the ‘extraordinary vaginal dilatation’ is explainable as occurring from the use of a ‘vaginal dilator’ for the cleaning of her genitals.
In this context, Genital examination not only of Aarushi’s and Hemraj’s body,but also of the other servants and suspected family members and friends should have been done to rule out or to establish any recent sexual contact of anyone of them with Aarushi,(as a doubt has been expressed about whether she had sex with her friend Anmol, and whether some others like Rajkumar had raped her), which doesn’t seem to have been done.
It is mentioned in Hemraj’s P.M. Report that ‘ his penis was swollen,’but it is also stated that his body was decomposed and bloated when it was discovered the next day after Aarushi was found dead in her room, which can explain the swelling. Also there is no report of any Forensic evidence of Hemraj having had sex with Aarushi, such as any pubic hair or semen identified as his,on Aarushi’s private parts,or Aarushi’s hair or blood on his. There is no definite eye witness regarding that either.
A doubt has been raised about why the doctor who did the postmortem did not report these findings at the beginning itself, and why he came out with them in the CBI Court during a later interrogation only.The reason could be that Dr. Dinesh Talwar, Rajesh Talwar’s brother, and his aquaintances among the U.P. Police who investigated the case first,had brought pressure on him when he was preparing the PM report to conceal the findings.The same thing is being said now by Retired Dy. Suptd. Of Noida Police, KKGautam in the special CBI court too, that he was requested by Dr. Sushil Kumar Choudhary, an Ophthalmologist friend of DINESH, on Dinesh’s behalf,to instruct the Govt.doctor to expedite the P.M,and ‘remove’ mention of ‘rape’ in the report for the sake of the Talwar family’s honour.’ Gautam said that he however declined to make any such intervention in the case. It is not known if DINESH Talwar secretly suspected Rajesh or one of the servant suspects of having committed the rape under influence of drink,because of which he was so afraid of the revelation spoiling their family’s prestige,and was in a frenzy to prevent such a thing from coming to light. For this, he might have induced the swapping of Aarushi’s vaginal samples with another woman. For,if the girl were alive,the rape would have to be hidden for Her honour, no matter who the rapist, even if he were a servant, whom the Talwars would not want to cover up.But,since Aarushi was murdered, there was no question of Her honour being at stake, or her being affected by the revelation; there would be only sympathy for her. However, if it were to be revealed that Rajesh, her father, or any close family member was guilty of the rape and murder,it would be very bad for the family’s prestige and highly embarrassing for the whole family.
The doctor did not take samples of Aarushi’s blood, though some wine bottles are said to have been found by the side of her body. He says that he didn’t take the blood samples because they are usually taken only when DNATesting is to be done. The significance of the presence of the wine bottles is not understood. If the crime scene was dressed up before calling the police, why were the bottles left there? Were they brought and kept there as a part of the ‘dressing up’? One would expect the assassins to take them away with them to remove the evidence. It is also not clear whether fingerprints on the bottles were taken.
The fingerprints of both the victims too haven’t been taken.
TheDNA testing of the strand of hair found in the mouth of Hemraj’s body, and the mark of a human bite, which was an indication of a scuffle between Hemraj and his assassin, was imperative ,as it would have helped to identify the person who is believed to be the killer of Aarushi too, judging from the similarity of their wounds,but this was also probably not done.There may be some swelling on the scalp of The murderer because of Hemraj’s forceful pull at his hair to restrain him. Hence, all the suspects should have been examined for any such injury on their head at the beginning of the investigations,but now the time has gone.
So much of the important evidence in this case, including the Khukri and surgical gloves found near Rajesh Talwar’s house, has been neglected as if the initial investigating agencies didn’t want to find out the truth,which is very deplorable.
As to the missing golf stick found from the Talwars’ house, two years after the murders, and supposed to be one of the weapons used in the murders, it was handed over to the police by Nupur Talwar one year after she and Dr. Ajay Chaddha ,Rajesh’s cousin and chidhood friend, found it in the loft. The club was in a clean and more shining condition than the other golf clubs of Rajesh’s set, as though well polished.
The exposure of his daughter to sex must have become known to Rajesh,so that he and Nupur got the scene ‘dressed up’ to make it look like a scene of nonsexual assault, which they thought would be believed as such by the investigaters, because of the tender age of Aarushi.
The only question is- if Aarushi was found only in an ‘objectionable but not compromising position’ with Hemraj, as claimed,which is supposed to mean that Hemraj was only ‘affectionately hugging and comforting ‘ Aarushi,who was upset because of her father’s alleged affair with Anita Durrani,and that his behaviour was misunderstood, then what is the explanation for the vaginal orifice being ‘extraordinarily dilated’,and ‘old tear in the hymen and fimbriation’ ?
And supposing, as said above, that the dilatation was due to the insertion of a dilator in Aarushi’s vagina, why should the parents get so aggravated or impelled to kill Hemraj and their only daughter? (That is, if they have committed the crime).It may be that Rajesh caught Hemraj just as the latter was ‘about to start ‘ engaging in the sexual act, considering that his underwear was found lying by the side of his body, which is why the parents inspected Aarushi’s private parts before or after her death,to know whether or not sex had taken place already.
More specifically, why would Dinesh Talwar have to ask the doctor doing the postmortem (Dr.Dohare) through the medium of some doctor named Dr. Dogra,to ‘remove’ any mention of sexual exposure or rape in his report, as alleged by Dr. Dohare? (This allegation, however,has not been proved ,as an examination of Dinesh’s mobile calls has not shown any such call). However,
The request to ‘remove’ mention of rape suggests that rape may have been committed on Aarushi!
Another doubt is,how come that the vaginal swab samples taken by Dr. Dohare from Aarushi’s body are suspected of having been changed or mixed up by the Pathologist,Dr. Ritcha Saxena,a friend of Nupur,following Dr. Dohare’s refusal to give assurance that he would avoid mention of rape, with the resultant P.M.Report showing absence of sperms?
Now,lately, it has come out that the DNA Of Aarushi has been extracted from the vaginal samples by a Forensic Science Lab at Hyderabad, and separated it from the other mixed up material in the slides, which is of some other person.
The latest report of the FSL has however said that there is no male DNA found in Aarushi’s vaginal samples, though the whisky bottle shows both male and female DNA, but then, what is the significance of Hemraj’s underwear being discovered by his side ?
There was a doubt about Krishna or his friend Rajkumar who went to the Talwar house that night having raped Aarushi, but CFSL, at a Ghaziabad court, has certified that the blood stains on Aarushi’s pillow do not match the ones on the Khukri found in his possession.
These mutually contradictory observations show that the Talwars are hiding something more that they consider as’ scandalising’ or illegal, that would be harmful for them,socially and legally,if revealed to the public.Perhaps, they are trying to conceal the evidence of sexual assault by some known person, to protect the honour of the girl,who is anyway dead, and for guarding the social status of the family, OR due to fear of blackmail/ displeasing someone influential.
However, to this day, some people are unable to digest the possibility that a father/mother can kill his/her only child, no matter what the provocation.
The answer is simple and akin to the fable of a mother monkey who,when stuck in a high drum or cylinder being filled with water,with her baby, tried ,her utmost at first to save the baby by keeping it over her head,but when the level of water rose to such a level as to threaten her own life,she put the baby below her feet and stood on it to save herself from drowning ! The moral of the story is-
One’s own life and security is more precious to everyone than anyone else’s,even one’s child’s .
This is what has probably happened in Rajesh and Nupur Talwar’s case, who might be loving their daughter,but when Rajesh felt greatly threatened because of her, for whatever reason, he might have struck her on sudden and strong impulse, leading to her instant death ,and he does not have the courage to admit his responsibility for it.

C) DINESH VERMA:
Recently, a new and intriguing angle has opened up in this case by the utterance said to have been made by Rajesh Talwar in Ghaziabad court on 24/5/08, after his arrest, that ‘Dinesh Verma framed me”, which has led to speculations among police and others about who this Dinesh Verma is,
why he would frame Rajesh Talwar.
Incidentally, Dinesh also happens to be the name of Rajesh’s elder brother,who is an Ophthalmologic Surgeon having his private practice,and living at Hauz Khas, New Delhi.According to CBI, he is the only Dinesh connected with the case. He is the one who went to meet Dr. Dohre to get the mention of rape removed fromAarushi’s PM report. Also, he is the one who brought the retired DSP KKGautam along with other police officers of Noida and UP and the Media to Rajesh’s house in his absence,on the very next day after the murder, and exposed the hidden dead body of the servant Hemraj, as well as the falsehood of The FIR lodged against that poor ‘missing’ servant, by Rajesh Talwar on the day of the murder, of having absconded after killing Aarushi.
So he is the only ‘ DINESH’ who had come into the picture immediately after the murder,before the arrest of Rajesh, and took action in relation to the murder case in such a way that the whole face of the case changed radically from an ‘open and shut’ case of a domestic servant killing Rajesh Talwar’s young daughter and absconding,as per the FIR lodged against Hemraj by Rajesh on the day of Aarushi’ s murder, to a mysterious double murder case strongly pointing to
the involvement of Rajesh himself in the murder.
However,there IS also a senior Dentist at Ghaziabad, U.P named Dr.Dinesh Verma.This Dr.Dinesh Verma is a Periodontist, MDS (Govt.Dental College, Chennai), working at Monica Dental Clinic,at Ghaziabad,U.P.
There is another who is Reader,MDS,( Oral and Maxillofacial Surgery), at Rajasthan Dental College and Hospital,Jaipur,too.
Both these Dinesh Verma(s) must be knowing Rajesh Talwar because of being in the same profession,
There is one more Dinesh Verma who is an Advocate member of the Punjab Haryana High court Bar Association Ltd.,at Chandigarh.
However, it’s not known whether any of them is associated with Rajesh Talwar closely enough to be able, or inclined to frame him out of professional rivalry or for any other reason.
So, in all probability, this’ DINESH framing Rajesh’ is his own brother, as the CBI has rightly guessed and said, long back in June 2008.
May be Dinesh Talwar was fond of Aarushi,and was in his heart of hearts very grieved and angry with Rajesh for killing her,which is why he made independent inquiry and effort to get her justice, even at the risk of exposing Rajesh Talwar, by having the terrace door opened against Rajesh’s will
And in his absence.
Yet,it is worth investigating into,in the interest of the case, the possible role of the Ghaziabad Dentist Dinesh Verma, who is more likely to be knowing Rajesh Talwar and some of the
Ghaziabad-U.P. Police and Court staff, to be able to give them reliable information about RajeshTalwar.
UPDATED(26.11.2013):
Recently, there has been a new revelation that a doctor named Dr. Lalit Verma, known by his surname Verma, a colleague Ophtalmologist working with Dinesh Talwar in the
Dr.Rajendra Prasad Centre of Ophthalmic Sciences, New Delhi , had accompanied
Dr.Dinesh Talwar, when Dinesh had gone to meet Dr. Dohre, and both had given Dohre their visiting cards. So the words uttered by Rajesh Talwar, while being led to the Ghaziabad Court,
may have been,” Dinesh, Verma framed me !”,Or ” Dinesh-Verma framed me!” ( Meaning both).
D) WAS AARUSHI KILLED BY THOSE CLOSE TO HER ?:
It is stated in a report that Dr.Vandana,wife of Dinesh Talwar (who is an Anaesthesiologist and has been I/c of the Obs.and Gynae. Ward at Safdarjung Hospital, New Delhi) had come to Rajesh’s house, after 1.30pm on 15/5/08 and had lunch with Aarushi and Nupur. Nupur left for Fortis Hospital at 4.00pm. Vandana too was there till 3.30/4.00pm,after which she left to pick up her son and then went to her clinic at Hauz Khas. She returned at 7.30p.m and both of them remained at home till return of Dr.Rajesh Talwar at night.
(Rajesh Talwar’s Driver, however, is supposed to have said earlier that Rajesh Talwar was on leave and had not gone to work that day. He is also said to have told that Talwar ‘couple’ returned home that night around 9.30-10.00 p.m). So Aarushi must have been alone with Hemraj that afternoon, from 4.00pm to at least 7.30pm, as Hemraj had not gone to the clinic that afternoon as per schedule, because according to what he told another servant at the clinic,Nupur told him to stay at home, since Aarushi was alone there.
Actually,It is said that arrangements were made for Aarushi to go to her grandparents’ place in the vicinity every day after school, and stay there till her parents returned home. In that case, it is surprising that she was left with the servant on the afternoon of the day of the murder.
If that is a fact, then I wonder, how naive and careless people can get, to leave a young girl of 14-15years in the hands of a male servant,however much older than her, just because maybe on that day, the grandparents were not at home!)
I agree with Sagarika Ghosh, Deputy Editor of CNN, IBN TV channel, who said that Nupur Talwar may not be legally responsible for her daughter’s murder, but she is morally responsible as a mother for the supposed sexual exploitation(if not rape) of Aarushi by their servants,and her murder, because she doesn’t seem to have been as vigilant in respect of her daughter as a mother of an adolescent girl should have .
Nupur herself however claims to have returned at around 7.30pm,from her clinic that day too.
Moreover, one Masooma Jha, mother of Fiza, Aarushi’s schoolmate and friend, is said to have
told reporters that Aarushi spent some time on the evening of the crime with them.
It is possible that Dinesh Talwar went to Rajesh’s house on that day’s late night to confront Aarushi,in view of a report in Aarushi’s resume on Facebook that she was beaten in her house that night (by Rajesh or Dinesh?) which is significant.The reason for it is not clear-whether it was because of her talking to Anmol on the landline on 15/5/08 about’ private and delicate family matters even after her father took away her cellphone to prevent her from phoning to him till late hours, or for her supposed growing undue intimacy with Hemraj.
That Dinesh Talwar is said to be the one to have taken active interest in involving Dr. Sushil kumar Choudhary ,and through him the retired Deputy Superintendent of Police, KK Gautam on 16/5/08, for making the request to the doctor who did the postmortem,not to mention rape in the report (as per that doctor’s statement), is also intriguing.Why should he have to make such a specific request if nothing like that is said to have happened, as her own parents claim? This makes one wonder if the girl was indeed raped before murder, and whether he knows who has done it. (Dinesh has however denied this allegation and his contacting anybody concerned with her autopsy to make any deletions in its report has not been proved on examination of his mobile calls either. )
Therefore, it is a matter of investigation whether Dinesh Talwar himself is involved in the murder case personally, along with his brother,as alleged by one Akshay Anand ,who claims to know Dinesh Talwar’s daughter,Shreya through his Website, or if he got the crime done through a servant of his brother or their friends(Krishna or Rajkumar?) because Aarushi posed a threat to the reputation of her whole family. Otherwise, why should there be an apparent effort by Rajesh’s business partners, Durranis, to shield Rajkumar?
Another possibility is that Krishna ,Rajkumar and Vijay Mandal(alias Sambhu?), under instigation by the Talwar’s former servant Vishnu or anybody else, or on their own,got into Rajesh Talwar’s house that night with the help of Hemraj, and helped themselves to the Ballantine Scotch Whisky on the dining table; afterwards ,the others gave an ultimatum to Hemraj to leave the Talwar house at once for Vishnu to rejoin, that was refused byHemraj, upon which they all attacked and killed him with a Khukri.
Probably, they had not intended or planned to murder Aarushi,as their quarrel was with Hemraj and Rajesh, but did so, after Rajkumar molesting or perhaps raping her, partly out of lust, partly due to anger, because of being threatened of exposure for the assault on Hemraj by Aarushi, who came out of her room on her own,on hearing the commotion outside.
Krishna, in a statement to CBI during the Narco test, said that he had gone to the Talwar’s place that night for revenge,(because Rajesh had scolded him badly and threatened to sack him for some mistake in the presence of patients in the clinic), with Rajkumar and Shambhu alias Vijay Mandal,and instigated Rajkumar to attack Aarushi sexually, but Rajkumar killed her on her threatening to expose him. Hemraj was killed thereafter for protesting against the murder and threatening to inform her parents.It is mentioned in one of the reports that the killer entrants in Talwar house that night had also gone near the Talwar couple’s bedroom, but did not or could not enter it.So may be the murderers intended to finish off the whole family, but succeeded in laying hands only on Aarushi and Hemraj too- due to Hemraj protesting against assault on Aarushi, or Aarushi threatening to call her parents.
However, they are being sheltered by RajeshTalwar’s friends themselves (especially Rajkumar,by his employees, the Durranis ,who have tried to prove him innocent by stating that he was present at their home that night and that the blood found on his shirt may be due to boils !), perhaps for fear of the servants being in the know about all the activities and secrets of their social circle,and the likelihood of their exposing the same if cornered.
Even so, , it is strange that even Krishna has been declared innocent and acquitted by the CBI too, just on the basis of the word of Krishna’s family only- that he was at home all night,and the haphazard noting of the colony’s watchman that none of the servants were in Rajesh Talwar’s house that night and that nobody from outside had come and left the house( it has not been specified from what time in that night. For Krishna is said to have admitted to the police of his visit at about midnight to the Talwar house that night for giving a khukri to Hemraj, who had asked for it the previous day).
This acquittal comes in spite of the doubt expressed by Rajesh and Nupur about Krishna’s hand in the crime, and confession by both Krishna and Rajkumar themselves of their entry into the Talwar house that night, as well as of their involvement in the rape and murders,Or at least the admission by Krishna of having been a conspirator and witness to the crime,which was committed by Raj Kumar, according to his statement (and not Rajesh Talwar,whom he declared as innocent),during the initial investigation.
( On another occasion however, Krishna is reported to have said during one of the initial interviews that Nupur told him to take the blame for the murders on himself and make that confession.So it may be that she tried to bribe him to take the responsibility for the murders in their place by offering him money, as rich people often do after committing a crime.)
In this context, it is pertinent to mention that the Delhi Police have informed Noida police that Hemraj was under their scanner as he was receiving calls from Maoists in Nepal ! It is not clear whether the calls were of a friendly or threatening nature and whether Hemraj’s fear for his life was due to them, or if he was indeed having evil designs on Aarushi.
There is a doubt as to whether there is any conspiracy against Rajesh and Nupur by their business partners-cum-socalled friends themselves and their police friends,perhaps in league with his own brother Dinesh too,for whatever reason-possibly to enable Dinesh to disentangle himself and the servants from the case and make Rajesh seem the sole culprit or scapegoat,or because of some internal strife between the brothers, perhaps for property dispute.
Of course, it is not as if Rajesh is absolutely above suspicion, but it is equally clear that he is not the only person or big head linked to the crime ,in view of the suspicious behaviour of Dinesh Talwar and KKGautam , Retd. DSP on the day of the murder and the next, viz the telephonic loop
Between them and Dr. Sushil Chaudhary, Dinesh’s friend, and an unknown Phone no.( perhaps of one of Noida Police Officers who came to the Talwar house on the day of the murder, but did not get the key of the terrace door lock from Rajesh, who drove them from his house to search for Hemraj outside,viz. Dattaram Nauneria or Mahesh Mishra, because no information about the whereabouts of Hemraj was obtained from anywhere till that afternoon, despite an award of Rs.20,000/- having been declared for anyone from the public who gave the information).
A servant alone could not have gone so far as to make important deletions in the camera ,internet and mobile phone of Aarushi, or attempt to change her password and her father’s, after committing the murders, on 19/5/08.
(Now, on 20/7/2012, strangely, an e-mail shown to be of the year 2008 had been issued and circulated among all the acquaintances of the Talwar family through Late Aarushi’s email address and in her name (aarushitalwar2008@gmail.com), that’Parents are innocent’,and it is detected that this has been done by Dr. Vandana Talwar, W/o Dr. Dinesh Talwar,though a dead person’s email account is not supposed to be used by anybody else.
This gives the clue that the attempt made in May 2008 to change Aarushi’s and Rajesh Talwar’s password must be the work of Vandana Talwar and her husband,with probably the knowledge and connivance of Drs. Rajesh- Nupur Talwar ,and not any outsider ! Vandana could as well have written that ‘Parents, Uncle- Aunty are innocent’ in the email ! It is intriguing to see that this e-mail is made to look like a posthumously received ‘Dying Declaration’ from Aarushi !)
A doubt has been raised by some about whether Krishna and Rajkumar or Umesh Sharma, i.e.any of the employees of Rajesh or the Durranis, were hired or used for the kill by Rajesh himself, because he couldn’t summon up the courage to do the execution himself.Quite possible ! That can explain why the parents ‘forgot’ to lock the door of Aarushi’s room that same night ‘by coincidence,'(or by plan?),and to take the key of the room with them to their room, which made it convenient for the ‘intruders’ to carry out their’job’. It also explains what Krishna is reported to have told the investigators at one stage,that Nupur told him to take ‘it’ on himself,whatever that ‘it’ means,and the cleaning as well as’dressing up’ of the scene of the crime and of Aarushi’s body. The problem is that the motive of the crime is still elusive.
However, it may well be Dinesh Talwar,and not Rajesh, who hired them for the murders.
Otherwise,why should KKGautam, a Retired DSP, not knowing and unknown to Rajesh Talwar,visit Rajesh’s house in his absence, next day, on May 17, ’08,on the invitation of Dinesh’s friend Dr. Sushil Kumar Choudhary,an outsider,unofficially(and by one of the Noida Police because of Rajesh’s reluctance to give them the key of the terrace door lock?),seemingly to offer condolences, but give orders to open the terrace door lock in the presence of Dinesh Talwar,thus exposing the terrace and body of Hemraj to his journalist friends whom he had gathered before hand,as well as to the local police and a top UP Police Officer on duty(Nauneria- the owner of the unidentified phone number in their telephonic loop that was created before KKGautam went to Rajesh Talwar’s house)?
Also,what was the meaning of telling them that there was likely to be an ‘ interesting discovery’ up there,as though he expected what they were going to see and had called them with the deliberate intention of letting them have ‘firsthand view and access’ to the scene,and using them as witnesses for implicating Rajesh(as well as for destroying evidence against Dinesh)?
Was Rajesh taken into confidence and his acquiesence to that step obtained beforehand?
If not, as Rajesh Talwar claims,then why was Rajesh’s terrace opened in the presence of Dinesh Talwar only, and why did Dinesh stay behind and call Gautam to Rajesh’s bedroom and request him in confidence to arrange to open the terrace door in Rajesh’s absence,instead of proceeding to go with Rajesh to the crematorium to collect Aarushi’s ashes for performing her last rites at Haridwar first time itself ,when he knew that Rajesh had avoided giving the key of that door to the police on the previous day?
It is true that Rajesh’s avoiding of giving the terrace door keys to the police for whatever reason, though the terrace door handle was supposed to be showing dried bloodstains, was absolutely unjustified,and that together with his feigning not to be able to recognise his own servant, and escaping from that place as soon as someone else named him, which smacks of guilty conscience, is what makes one question his innocence, and suspect his hand in the murders.
( Nupur though, is said to have affirmed that the body was that of Hemraj from the tailor’s label on the inside of his shirt collar).
However, Dinesh’s action of calling and requesting KKGautam to get the door to the terrace opened by breaking open the lock -which Rajesh was clearly trying to avoid- in his absence,raises doubts about Dinesh’s motives and his role in the crime also, esp.in relation to Aarushi,whose Postmortem report he is reported to have tried to influence, and about whether he is secretly trying to save his own skin and get Rajesh and Nupur trapped, suggesting that all is not really well in the relations and mutual loyalty of the brothers.
Perhaps it was at Gautam’s place that the killer( whoever it was) stayed that night, considering the statement under the title of the article ‘Do you think Dr Rajesh Talwar killed Aarushi (on whom he doted) and Hemraj?’ published by the Merinews Website that-
“The phone of Aarushi remained within the vicinity since KKGautam stayed there.”
In this context,it is indeed a matter of speculation whether, as said before,Dinesh Talwar himself is that Dinesh Rajesh shouted at, while being taken to the Court on arrest, considering the initiative taken by him to bring KKGautam to Rajesh’s house in his absence, the very next day after Rajesh’s avoiding of giving the key of the terrace to the police, in the name of offering condolences,and then getting the terrace door opened through Gautam in full view of the local and top UP Police Officers and Media.
However, there is another view taken by CBI of Rajesh Talwar’s absence at his house on the occasion of opening of his terrace,viz. deliberate avoidance of being present on the site when Hemraj’s body was found and exposed to the police,on the basis of the testimony of the priest of the cremation ground where Aarushi was cremated, Krupa Shankar Tripathi, that the Talwars had opened a locker there on 17/5/2008 morning to keep Aarushi’s ashes, and they were to go for their immersion to Haridwar the next day. However, they returned within half an hour to take away the ashes, saying that the elders of the family told them that the ashes of an unmarried young person should not be kept in the hose for long,and should be immersed the same day.
A neighbour of the Talwars, Mr. Tandon, in whose terrace Aarushi’s blood soaked mattress was kept, also testified in the court today that the Talwar’s terrace had never been locked before that day, and that it was not the Talwars,but he who took the initiative to call the police in the morning of the day of the murder, because a relative of the Talwars said their landline phone was not working. The CBI however,said that this was not convincing as the Talwars could have used their mobile phones to call the police if they wanted to.
The alibi of the landline phone not working,on the morning of the murder – 16/5/2008, is flimsy ‘,as it was working allright till the previous night, judging from the fact that Anmol, Aarushi’s boyfriend, is said to have spoken to her on that phone at about 11.00 P. M., as her mobile had already stopped responding after their last talk on it upto 9.10 P.M.( In that case, it should be known what reason Aarushi gave him for not responding to him on the cellphone after 9.10 P.M, as the countdown of her gruesome murder that was to follow an hour or two later seems to have already started since 9.10-9.50 P.M., considering that her maternal uncle is supposed to have told the the investigators that Aarushi was beaten that night, for reasons not disclosed).Thereafter, when he phoned on that landline which is in the bedroom of Aarushi’s parents at midnight,about 00.08 A.M(12.08 P.M at night), the phone kept ringing but no one lifted it somehow. Nupur has said during the police interrogation that she had gone to sleep in her bedroom just after 11.00P.M on 15th night of May 2008. In that case, at least she should have heard the ring, if not Rajesh , who was said to be busy on his Internet, unless she purposely chose to ignore it. Or the ringer of the phone may have been put off, as she did sometimes to avoid receiving very late calls.
(An SMS sent by Anmol to Aarushi’s cellphone at 00.30 A.M (12.30P.M), because of his repeated failure to be able to speak to her on her Mobile after 9.10 P.M.,and on the landline also at12.00P.M,remained unreceived too.What was going on in the Talwar house between 12-12.30 that night, and where were Rajesh and Nupur Talwar, or what were they doing then? Was everybody engrossed or engaged in the murder being committed at that moment, so that no one noticed the phone ring?)
What is suspicious about Anmol’s repeated efforts to contact Aarushi that night from 9.00- 12.30 P.M in one way or the other, first by talking to her on her Mobile, then on the Talwars’ landline, and by SMS at 12.30 at night,after she became unavailable for talk,Is that he seems to have been highly anxious about something. It may be that he had got some foreknowledge of what was to befall Aarushi in her own house that night and wanted to warn her thereof in time, in advance,for which he had phoned on the Talwars’residential landline also at around 11.30P.M, and managed to get her on the line then, but their talk was interrupted and stopped abruptly within 34seconds, probably by her parents.
It might have saved Aarushi’s life if, on his ring on both, her Mobile and the Landline being unattended at 12.08 midnight, he had informed the Noida Police about his worry then itself. But,Perhaps, he feared that his trying to contact her repeatedly at that late hour may arouse the doubt of the police against him only, in view of his age, especially if there was no criminal record against the Talwars till then . And in case Rajesh Talwar had good contacts with the Noida Police, they would have told him about the boy’s complaint then and there, bringing Anmol Agarwal himself under Police suspicion and arrest. Worse still, the boy might even have been implicated in the crime being plotted , taking advantage of his ‘frantic’ efforts to contact Aarushi at that time.
Anmol should therefore be questioned gently in confidence by the CBI about the actual reason for his trying to contact Aarushi again and again that night, to get the truth out from him, during this present session of Court trial itself,in the interest of justice to Aarushi ,as he was the last outsider and friend to have spoken to her that night,just1/2 -1hour before the presumed time of her murder, I.e. between 12.00 ( midnight) and 1am on16/5/08.
It was found that the Router of Rajesh Talwar’s Internet, which is in Aarushi’s room, was on till 3.43 A.M.on 16/5/08. In many houses, the Router and the Landline share a common switch board and wireline. So, it follows that the Landline phone must have been in working condition till then. What could be the reason for it’s going out of order thereafter ? In some houses, when the router is put on for working on the Internet, the landine phone becomes unavailable for talk for the time being. The same thing happens if the ringer of the phone is taken off. Something like that might have happened in this case too, as the router was seen to have been put on at 6.00 A.M, I.e. almost immediately after the Talwars woke up on 16/5/08 morning,and, according to their claim, first saw the Aarushi’s murdered body.Again, it’s from the same phone that Nupur made the call at 6.01am to Hemraj’s mobile which has been recorded as received for a few seconds before disconnecting. The same phone was said to be out of order within as little time as by 6.15am,at which time the neighbour Tandon came there and asked whether the police had been informed!Ultimately, it was Mr. Tandon who took the trouble of informing and instructing the Security Guard to intimate the incident in L-32 to the Noida police and call them over!
So a doubt arises whether the Talwars deliberately disconnected the Landline phone line as part of the ‘dressing up’ of the crime scene.
Therefore, it is uncertain whether the neighbours Punish Rai Tandon and KKGautam are acting as friends of the Talwars, or secretly and unofficially helping the Police and CBI, seeing the way in which The latter shook himself free before the CBI Court,by denying any acquaintance with the Talwars prior to his visiting Rajesh Talwar’s house ( which is said to be in Gautam’s neighbourhood in Noida) on 17/5/08,on Dr. Sushil Kumar Choudhary’s request ,as also of any involvement in their effort to influence the doctor who did Aarushi’s Postmortem,to avoid mention of rape in the report.
Well, if whatever he did or said was in good faith and in the interest of justice to Aarushi, it was the right action on his part.
It would have been helpful to hear what the milkman whose phone on Hemraj’s mobile at Talwar house on the night of the murder,had to say, in the CBI court.
UPDATED (22.6.2012):-
E) AARUSHI DIED OF MTP ?:
One More Possibility, in view of the several (250)phone calls said to have been made by Nupur Talwar to a lady doctor during the week,and 21 calls on 15/5/08,is that she may either have made those calls to Anita Durrani ,(to whom Rajesh Talwar too is said to have made 197 calls around the same time, and 6 calls on 15/5/08 night ), to find out what was going on between her and Rajesh,as both Anita and Rajesh had not gone to their clinic that day.
Or she may have contacted a lady obstetrician on suspicion of Aarushi having become pregnant, because of her excessive intimacy with some boys,esp.Anmol,with whom she had 688 cellphone contacts within the last 45 days, and perhaps with Hemraj too.Aarushi is said to have made a confession over her Orkut site to her parents about some trespass committed by her, “as many do nowadays”,and apologised for it while promising not to do ‘it’again as they did not like it. It is not clarified what that ‘it’ was about.
So, the whole bloody event could be the result of an effort to get her aborted at her residence surreptitiously, with the knowledge and help of a doctor who would not divulge the secret outside. Perhaps Vandana Talwar herself, being an MBBS doctor,anaesthetist and i/c of a Gynaecological Operation Theatre,may be having some experience of Medical Termination of Pregnancy,and thus, ventured to do the job for her family’s honour, as the lady doctor(Obstetrician?) consulted earlier
by Nupur, to whom she is said to have made 21 calls on Thursday, 15/5/08 also,might have refused to do the MTP;and she,Vandana, may have agreed to do it,suspecting a close familymember of being responsible for the problem.
The blow on Aarushi’s head maybe because of her refusal to undergo the operation, in spite of all the persuasion, camera gift, and beating by her parents to force her to agree for the MTP.
In view of this, the gesture of giving the camera ordered for Aarushi’s birthday, more hi- tech and costlier than the one she had asked for, before her birthday, may have been their last effort to persuade Aarushi to agree to undergo MTP,which she may not be wanting, in case she was expecting a love- child from Anmol (or Hemraj perhaps ),which she may be wanting
In fact, it may also be that Anmol was phoning frequently and frantically to her on 15/5/08 night, as he might have come to know of the plan of Aarushi’s parents to get her aborted that night, and may even be instigating her to run away with him immediately, to escape the MTP, as he too may be wanting to marry her instead,and keep the child,of which Hemraj had come to know.
Otherwise, why would Hemraj be blackmailing her over him, as one report says ?
Hemraj might have been struck for being a witness to the operation,and perhaps of the (rape by Rajkumar, or ) sexual relationship/affair between Aarushi and Anmol also, for which he was blackmailing her. Or, for being suspected of being responsible for Aarushi’s condition himself.
Aarushi may have collapsed during the process of Abortion by Dilatation of the Cervix and Curettage of the Uterus( D and C ), so that Vandana and the parents got scared and finished her off by slitting her throat, to divert attention from her private parts. (This could explain the absence of sperms despite the dilated vaginal orifice.)May be this was also what DINESH Talwar was trying to do, by influencing the Doctor doing her P.M, to withhold any evidence pointing to rape, for the sake of the family’s honour, thus,cleverly, giving him a leading hint,in order to ‘turn his mind to’look for signs of Sexual assault like Rape by an Outsider, and think of the dried white liquid inside Aarushi’s vagina as semen,( or natural discharge), which any body would be led to suspect and believe,in the case of a young girl, rather than a ‘ Medical ,I.e.Surgically induced Sexual Assault’ like MTP ,or Tampering with her private organs by invasive procedures like Dilatation and Washing/Cleaning of the Vagina, by ‘Medical Insiders ‘!
However, there is no clear proof of effort being made to induce MTP In this case. Could it be that Aarushi had reached a stage of pregnancy when its termination was no longer feasible, because of which the family, after trying that first,killed her to save their honour,i.e. ‘honour killing’ by slitting her throat !
The vaginal dilatation may be because of an attempt to do P.V.(Per Vaginal examination)of Aarushi with the use of a Vaginal Dilator,to know whether or not Aarushi was exposed to sex,whether she was pregnant, and if so, in what stage, as well as to wash out her vaginal canal,in case of any suspicion.
The other possibility of course is that the sperms may have been washed out due to the cleaning of the private parts if it was a case of rape.Dr. Dohre,who did Aarushi’s P.M, has stated that the girl’s private parts seem to have been washed, which is obviously the work of some insider. For why would a rapist or assailant stay on to wash his victim’s private parts ?
That both Vandana Aunty and Dinesh Talwar were also there at Rajesh Talwar’s house on the night of 15/5/08, has been suggested by one Akshay Anand claiming to be knowing Shreya Talwar, d/o Dinesh Talwar and cousin of Aarushi ( Ref. his letter dtd.Feb.14,2011, on Google through http://www.You Bihar. Com,Bihar Social Networking).
F) MYSTERIOUS SURROUNDING PEOPLE:
It is mentioned in one report that there were bloody footsteps of someone inside Aarushi’s room but not outside.This may be because the killer/s, whoever it was,may have removed the footwear outside the room and come into the room on tiptoes to catch the person/s inside unawares, committed the murder of Aarushi and left after putting on the footwear again. These bloody footsteps should have been investigated by their size and other ways to identify the secret prowler/s,and to know whether it was insider/s or outsider/s who were lurking around that room that night to execute his/their murderous intent. Instead,Driver Umesh Sharma and the other domestic staff of Rajesh Talwar washed and cleaned the floor of Aarushi’s room and the Door Mat of that room, and ‘ washed clean ‘ the footprints and other evidence, with the consent of the Noida Police , at 4.30 P.M on 16/5/08 ( that means even without waiting for Aarushi’s Post Mortem report to be officially declared ?)
One more thing that needs to be brought to notice, is that a mystery scrapper was said to be visiting Aarushi regularly on her Orkut profile,who reminded her of murder victims on Internet sites, which is suspicious.It is not known whether this person was just trying to scare Aarushi for fun, or was wanting to warn her about something,or had anything to do with her murder, and should be traced and taken to book at the earliest.Perhaps Aarushi’s other friends , especially her boyfriend Anmol, who were also corresponding with her on Orkut, may be able to give useful lnformation about the person’s identity, as it is likely that the scrapper might have been old boyfriend of Aarushi, whom she left for Anmol Agarwal.
The whole problem is that while the Talwar couple says that they want the case to be followed up and seek justice for their child,they are not willing to shed their tight- lipped and secretive behaviour, because of which they give the impression of constantly concealing and withholding some important information from the investigating agencies,e.g Who is Dinesh Verma and why he should frame Rajesh.
Is it because of any professional rivalry between this Dinesh Verma and Rajesh Talwar, due to his hitherto flourishing practice ?Or their strained relations maybe because of some social squabble between them for whatever reason.
G) THE LACKADAISICAL ATTITUDE OF NOIDA POLICE and CBI :
The indifference of the Noida Police and CBI’s ‘unwillingness’ to take serious and prompt heed of the longstanding demand of the Talwars for the ‘Touch DNA’ test to be done on the fingerprints on the bloodstained Scotch Whisky bottle on a table in Talwar house also raises doubt about whether they are trying to hide the identity of the real killer/s under someone’s influence and pressure.
However, it is mentioned by the CBI that they have examined the fingerprints on the Ballantine Whisky bottle on the table,which indicated the presence of a ‘fifth person’in the Talwar house on the night of the murder,as the fingerprints do not match those of the occupants of the house ,or any of the suspects, viz. Krishna,Rajkumar and Vijay Mandal.
It may be noted that the only person who is neither an occupant of the house,nor a suspect so far,is Umesh Sharma,Rajesh Talwar’s driver, who had come to the Talwar residence that night at around 10.00p.m under the pretext of giving the car keys and Rajesh’s bag,but who doesn’t seem to have been taken into custody and interrogated elaborately like the other servants so far,and has been spared for some reason, though it said that he was thrashed by the CBI personnel after questioning him about the missing evidence and items related to the murder.If he was so innocent that he was not taken into custody with the others, what was the need to thrash him ?It is worth checking therefore, whether his fingerprints have been taken and tallied with the unidentified fingerprints of the ‘fifth person’, and doing it if the tallying has not been done till now.
H) CONTRADICTORY CBI REPORTS:
It is seen that some of the findings reported are contradictory to one another,e.g.in CBI reports, it is stated that only Aarushi’s blood was found on Rajesh Talwar’s clothes on Forensic examination, but not of Hemraj,and that Nupur’s dress was clean, whereas Umesh Sharma, driver of Rajesh,Talwar’s maidservant, Bharati, and Even RKSaini, CBI’s Own counsel, say that his clothes on16/5/08 morning were the same as he was wearing on the previous evening,and without bloodstains.Who is to be believed?
However, the Forensic tests, which have been able to detect small amounts of blood barely visible to the naked eye, could indicate that Rajesh killed Aarushi, and Hemraj was killed by an accomplice, whosoever it may be. He and the accomplice may have worn an apron over the clothes after hitting the two with the stick before slitting their throats,hence the absence of stark blood on Rajesh’s clothes. The bloodstains on the Scotch Whisky bottle in Talwar house have been confirmed by FSL , Hyderabad that they do belong to the two victims.
Yet another discussion is about whether Hemraj had consumed liquor that night or not, with some reports saying he did, considering the presence of three glasses and some wine bottles on his table and some denying it. Probably, he did.
One more point of dispute is about whether Rajesh and Nupur Talwar were the only people in their flat that night with the murder victims,as according to the statement of the colony watchmen,or whether there was a ‘fifth person’ in that house too,as suspected by the presence of fingerprints on their whisky bottle that did not match the fingerprints of any of the known people inside the house. That ‘fifth person’ has not been identified or verified yet.
What is not understood is that if the culprit/s are people known to the Talwars,whom they are trying to protect, as supposed, why would they insist on the ‘Touch DNA’ test for detection of the murderer/s ? Have they managed to get some unsuspecting person,to touch the Whisky Bottle before the investigations for trapping in the case?
I ) ROLE OF NUPUR AN ENIGMA :
About the role of Nupur in this case, it is as mysterious or enigmatic and inscrutable as her behaviour and her studied ,resigned, ‘matter of fact’expression,which seems to speak as if “whatever has happened is bad, but it was an unavoidable,though painful, necessity,”that lends credence to the general suspicion of honour killing. She exhibits a remarkable control and composure, which looks like indifference.
(It is learnt that the Noida police have given credit to Rajesh Talwar by saying that it was he who informed them on 17/5/08 morning that there might something important on the terrace,eg eeapon of the crime,but his brother Dinesh claims that the police had come to know about the blood stains on the terrace door and railing around on May 16/2008 itself.)
J) WAS RAJESH THE ACTUAL TARGET ?:
One more possibility suggested by some, is that Krishna had actually come to assault Rajesh that night,but on being opposed by Hemraj, got furious and attacked him instead with a hammer or stick and Khukri, after taking him to the terrace,and Aarushi too,who came out of her room on sensing some trouble outside,to remove her as a witness. It is learnt that Krishna said under narcoanalysis, that Rajkumar and Shambhu had gone towards Talwars’ bedroom, but came back on finding that door locked.
However, this theory makes it even more difficult to understand Rajesh’s resistance to opening the terrace door before the police, for,normally, a person who has lost his only child and suspects a proposed attack on himself,would be the first one to want the door opened.
K)PLOT AGAINST NUPUR TALWAR ?:
At the end,one more doubt has come up due to Nupur being held in judicial custody for three long months without bail in spite of there being no sound proof against her of involvement in the crime,while Rajesh,the co-accused, was enjoying the freedom of prolonged,uninterrupted bail since July 2008,about whether there is a plot being hatched by Rajesh Talwar,Anita Durrani,Dinesh Talwar and Rajesh’s supporters among the police,CBI and legal system to make Nupur the scapegoat eventually.
For, ever since the closed case has been reopened for hearing, in Jan 2010, her name is being included as guilty for offences, one by one, that were lodged only against Rajesh Talwar till now, in all these four years,viz. Making her a coaccused for the murders with common intent, and now declaring that the blood and female DNA of Aarushi has been found on her clothes too, besides Rajesh’s. No such fresh, additional ‘ discoveries’ are being reported against Rajesh, who was till now, the main accused.
L) CONCLUSION :
Finally, a decision is reached about the identity of the killer/s,by the CBI on 16.4.13, i.e.Rajesh himself alone, killed Hemraj,and Aarushi along with him by accident.
As to the Talwar brothers, it may be said that on the basis of the existing proof,Rajesh appears to be the one directly responsible for the murders,at least of Aarushi,as his relations with daughter Aarushi were strained,and ,he was awake and working on the computer till around 12.00 p.m (midnight) on 15/5/08,i.e a very short while, a couple of minutes or just an hour before the estimated time of the murders,which is anywhere between 12.00hrs.(midnight) to 1.00a.m on 16/5/08 or possibly earlier than 00.30a.m when Anmol’s SMS failed to be received by Aarushi’s cellphone. Nupur had gone to sleep after 11.00pm.
Dinesh Talwar too,is almost openly involved to a great extent in the surreptitious cover-up of evidence , in Aarushi’s and Hemraj’s murder case, as appears from his contacting the doctor doing Aarushi’s postmortem not to mention rape in his report, but somehow he has been acquitted by CBI, may be because of his friendship with Dr. Sushil Kumar Chadhary, who in turn,has powerful contacts in the Police Dept. through KK Gautam.
(For, as mentioned before by one Akshay Anand,who claims to know Shreya,d/o Dinesh Talwar,on ‘You Bihar.’com, Bihar Social Networking, Dinesh Talwar had come there and started it all by hitting Hemraj,with Rajesh following suit by striking Aarushi,allegedly on Hemraj being caught red-handed in Aarushi’s room at that late hour, and their wives, Vandana and Nupur Talwar also joining in to help the Talwar
(Thinking of it,Hemraj himself too may not be as innocent as he seemed to be . For one website, The Pioneer is said to have reported that he knew about Aarushi’affair with a boy and was blackmailing her for it. It is also learnt that he was getting calls from Maoists in Nepal , as reported by the Delhi police to the Noida police. So it may be more on their account that Hemraj feared for his life actually,and not so much because of the Talwars.)
One source has even said that Hemraj misbehaved with and killed Aarushi and then himself got murdered by the people in whose presence he had molested Aarushi, though why his own acquaintances should kill him for molesting and killing Aarushi is unclear. It is more likely that they saw and misbehaved with, and then killed her and him.
Being threatened by the killer/s could be the reason why Rajesh Talwar was hesitant to open the terrace before the police on 16/5/08, and allowed the body to rot on the terrace for 24 hrs.till the next day.)
In that case, Aarushi’s murder may be truly a domestic tragedy, wrought by her.
A point has been raised about how the two workers of Rajesh did not notice the body of Hemraj when they went up to the neighbour’s terrace for keeping the bloodstained mattress of Aarushi there,which they have explained by saying that they did not see the body because it was placed close to the dividing wall on the other side and covered with the cooler lid.
(By the way, it is surprising that Mr.Punish Rai Tandon, the neighbour,allowed them to keep that murder proof on his terrace, if he was informed and his prior consent for it was taken, that is ! However,no suspicion has been raised about his connection with the crime
The whereabouts of Rajesh Talwar’s car and trips made by Umesh, driver on 15/5/08 with Rajesh, who, Umesh said did not go to his clinic that day ,but returned home late,at 10.00p.m ( 11.00 p.m.according to some reports) and thereafter,should also be inquired into and scrutinised for any dubious movements. It is said that both Rajesh and Anita were on leave that day, and he is said to have made six calls to her on Thursday night. Since Umesh was driving him around, the particulars of all the places Rajesh visited that day must be known to him.
So, it is likely that he was taken into confidence to carry out or to participate in the execution of Rajesh’s macabre plan,and asked to stay over at the Talwar’s place but not within their house- i.e. on their terrace itself (?),or close by within a calling distance,that night ,for the purpose,perhaps within the building with Vijay Mandal, the neighbour’s domestic servant, who,according to the statement of his employer,Punish Rai Tandon, had slept in the garage that night (from where a foul smell was reported to be coming during the police investigation soon after the murders), and left in the early morning quietly after locking the main door from outside.
India TV channel has hinted at the hand of Umesh Sharma in the murder by mentioning in their Video Report in Hindi, that “Aarushi ki body ko postmortem ke Liye le Jane ke baad ghar ke naukaron ne Uska room dho daala. Aur phir ‘quatil’ ne uska khoon se sada Gadda Aur cheddar uthakar padosi ki terrace par daal ‘Diya”. It is generally supposed that no outsider would stay on to clear the site of the crime, but Umesh, being an employee of the Talwars , got the chance to stay back at Talwar’s house and remove much of the evidence in the name of cleaning Aarushi’s room, officially- after the body was taken by Rajesh and brother Dinesh for cremation- which he says he did with the instruction and kind consent of the Noida Police.
The Forensic Science experts examining the evidence in this case have opined that Aarushi’s murder was committed by someone ‘very close’ to her.Hence it follows that either her father or uncle,or both,being her closest relations,besides her mother, must have killed her for family honour or whatever motive. For Anmol, her boyfriend, and Hemraj, the other two persons close to Aarushi, do not really seem to have any hand in her murder, as Anmol was not around her when it happened, and Hemraj himself was also put to death the same night in the same manner.
Hence, the ‘Paanchwa Kaun’ that was there in Rajesh Talwar’s house on the night of 15/5/2008,besides the two murder victims, and Rajesh -Nupur Talwar, could be either Driver Umesh and/ or Raj Kumar,or perhaps, Dinesh Talwar, though the CBI has let them go scot-free!
MAIN QUEST OF TALWARS :
So far as the striving of the Talwars is understood, their main aim and wish is to prove three things,for the sake of saving the good image of Aarushi Talwar and her parents, with the help of truth or untruth, viz.:
(1) That the assault on Aarushi leading to her murder was a non- sexual attack;
(2) The double murder of Aarushi and Hemraj was not committed by Rajesh or Nupur Talwar; and (3) There was no sexual or clandestine relationship between Aarushi and Hemraj or anybody else.
In short, it appears that they’re actually more interested in making the CBI arrive at a ‘theory’ which,besides freeing them of the criminal charges against them,restores the good image and dignity of Aarushi and themselves in society , in the name of defending Aarushi’s honour, rather than in driving the investigating authorities to find out ‘the identity’ of,and punish the ‘real killer’.
The Talwars claim that the double murder is the work of the servants of their clinic and of their business partner,because of some internal fight between them and Hemraj, in which Aarushi,unfortunately got trapped in as an unplanned victim by being an accidental eyewitness to the scuffle.
They also explain why they did not get alerted in time by the commotion and deadly happenings in their house just in the adjoining room of their daughter,by saying that they could not hear the sounds because of the loud noise of the Air Conditioners in both the rooms .
Agreed .
BUT-and here is the crux of the matter- that it is not at all convincing that the servants would have lingered at the site of the crime after doing it,at the risk of being caught ,just to clean up Aarushi’s room,bed and body. Instead, if they are clever,as they seem to be, they’re more likely to have used gloves ,aprons and stockings for committing the murders from the beginning to avoid being detected through their fingerprints or any other signs (as is seen from the print of a hand on the terrace wall,which did not reveal any fingerprints. Nevertheless, the investigators have succeeded in extracting and showing the DNA obtained from that handprint to be that of Hemraj.)
However, Umesh Sharma did carry out the disposal of murder proof like Aarushi’s mattress, and participated actively in the cleaning and washing of her room. Could it be that he stayed over in the building garage that night without the knowledge of the Talwars,and committed the murder of Hemraj single-handedly or with some outsider ?
But, if the parents have done the cleaning,what could be the reason?
Perhaps, or probably, both Rajesh and Nupur Talwar had agreed to a pact with any one or more of their servants, probably Umesh, (on feeling the need to do away with Hemraj,whose activities they had started finding embarassing, obnoxious, troublesome and alarming to the point of exasperation and distress for whatever reason )
According to me,That may be the reason why the Talwars emphatically deny having murdered Aarushi-Hemeraj ,and were pressing the CBI so confidently to get the ‘Touch DNA’ test done, because they, THE TALWARS HAVE NOT MURDERED AARUSHI-HEMRAJ,but THE TWO WERE KILLED BY OTHERS, probably Umesh driver, (who is working loyally with Rajesh to this day and has turned into a hostile witness on 14 th September 2012 , by refusing to identify the two golfsticks of Rajesh Talwar before the CBI Court.
What might have happened is that the Talwars hired some person/s for eliminating Hemraj alone, so they gave the required instructions to those people, and then went and locked themselves inside their bedroom,but, at the crucial moment, Aarushi came out of her room on hearing unusual and suspicious sounds, and fell prey to the assassins by threatening to phone and call the police immediately. Thereafter, when the parents came to know that the hired persons had killed their only child also along with Hemraj, possibly assaulted sexually before murder,they became crestfallen , but also became conscious of the ‘value of life and personal honour- theirs’.
That is why they first got Hemraj’s body shifted to the terrace and locked it to avoid arousing immediate doubt in the minds of people about their involvement, and to misguide everyone into thinking that Hemraj had killed Aarushi and run away, with the hope that the police ,media and the public would leave their house and go elsewhere looking for him, which would give them a chance to dispose of his body without anyone noticing, but could not do so.(Hence their reluctance to give the terrace lock key to the police) .
Then,they cleaned and ‘dressed up’ Aarushi’s body and bed,and threw the key of Aarushi’s room in the passage before calling anyone, and before the maid Bharati’s arrival. Thereafter, they behaved as though they had just seen Aarushi’s body, and gathered their family and friends,followed by the police.
The subsequent investigations had led to the closure of the case byCBI without any further arrests, after the initial arrest of Rajesh Talwar and the three servants,and only with the remark that the circumstantial evidence pointed to the involvement of Aarushi’s parents in the double murder, but that the case was being closed because of lack of clinching evidence of anyone’s guilt,since much of the evidence had been tampered with before they took over the case.
However, this closure of the murder case by CBI emboldened the Talwar couple to challenge the CBI’s decision- under the overconfidence that they were beyond the clutch of the Law – in the name of redeeming the honour of Aarushi Talwar and her parents, and in the interest of justice to them.(Forget about poor Hemraj. The case has now got reduced to just the Aarushi Murder Case !)
It is this move that has proved detrimental to them,particularly to Nupur, who was more assertive in the fight for ‘justice’.
The presence of unidentified finger prints on the Scotch Whisky Bottle and three wine glasses on Hemraj’s table suggests the definite presence of outsiders in the house that night,notwithstanding the colony watchmen’s statement that no outsider had entered that house that night, even though his/their identity may not have been proved or revealed yet. For the fingerprints of all the occupants of the house,and the three servants Krishna, Rajkumar and Vijay Mandal have been taken and are not matching with those on the Whisky bottle.
In that case, the only ‘known outsider’ who had come to the house that night and whose fingerprint matching report has not been declared clearly, is Driver Umesh Sharma.
However,the CBI seems to believe him to be innocent also,so the only other possibility is of an ‘unknown ‘ outsider,or someone known to Hemraj only.
M) HAD THE TALWARS GONE OUT PARTYING ON 15/5/08 NIGHT ?:
One person has come up with the theory that Rajesh and Nupur WERE at their residence till about 12.10-15 hrs. on 15th May night, till Rajesh finished his work with his Internet, as they claim, but left the house thereafter to attend a party at a hotel,from which they returned home in the early morning on 16/5/08-at about 5.00a.m. Or may be they came back earlier, at 3.43 a.m,and opened the main door with their own key, after which they remembered the router and put it off. In that case, they must have seen Aarushi’s dead body at that time itself and ‘dressed up’ the scene, unless the router was switched off without putting on the light for want of suspicion.
However, the Talwars strongly refuse that allegation and insist that they were at home throughout the night but had gone to sleep so that they did not know what happened or who came and murdered Aarushi and Hemraj that night. It is however possible that they may have gone out, but not to the hotel, and do not wish to disclose where they had been.
N) MY CONVICTIONS :
One can think of all sorts of possibilities in this case. However, I am sure of two things:-
(1) It cannot be said with certainty that Rajesh Talwar was not involved personally in the double murder,because of his evasiveness and noncooperation in opening the terrace door on the day of the murder by not giving the key of that door’s lock to the police; he did not even urge them at that time itself to break the Lock, but just walked away to his flat, which is very suspicious.
Also the fact that their previous domestic servant Raju Nepali is reported to be dead,or at least hiding for fear about danger to his life from the Talwars, raises suspicion about whether the Talwars, especially Rajesh, who is said to possess a bad temper, are really people with a murderous bent of mind.
Still,it is fairly definite that he has NOT committed incest with his daughter before her murder, for otherwise Nupur would not be able to be as sympathetic and supportive towards him as she is , because now she thinks that whatever he did was for his family’s honour, and not for any selfish purpose.
(2) Nupur is definitely not involved personally in the murders, as she was sleeping since 11.00pm and was supposedly not even present at the place of murder when it happened, as per most reports.
One report states that she was present at the site when Aarushi’s throat was slit, but that seems to be an unauthentic report, as there is no witness to testify that.
However, recently, a strange new fact has been discovered and confessed by her, of having an intimate relationship with a close family friend, Dr. Ajay Chaddha. The reason for bringing up this matter in court during trial for Aarushi- Hemraj murder is not understood. Is it implied that the Rajesh-Anita affair wasn’t the only thing that Aarushi objected to, and that Nupur’s affair was another cause of her clashes with her parents ? It’s not known how Rajesh is feeling about it, but it may be that there is an understanding between the husband and wife to the effect-” Hum bhi Wafadar nahin, tum bhi to Dildar nahi”!
UPDATED on 6/7 -8- 2012:-
O) PARTIAL MALE DNA ON PILLOWCOVER IN AARUSHI’S ROOM ?:
Lately, a forensic expert from CFSL,Delhi,B.K.Mohapatra, has told the CBI Special Court about the presence of ‘partial male DNA’ on a pillow and its cover in Aarushi’s room, besides her own blood stains, which is believed to be that of Hemraj (which indicates that he was caught and killed in her room.)This item, under Caption No. 13, is said to have been found and sent to the Central Forensic Science Lab., on June 4,2008 by the Superintendent of police ( CBI Officer) RSDhankar,as recovered from Aarushi’s room,though he was not part of the investigating team on June 1,2008. ( Till now, the CBI has been reporting constantly that no male DNA was found in any item from Aarushi’s room.)
The ‘Partial male DNA’ has also been found along with Hemraj’s blood stains on the railing of the staircase leading to the Talwars’ terrace . The DNA profile obtained from the pillow and cover matches the DNA profile of the Whisky bottles and the terrace wall as well.
However, a Recent report says that the pillow and cover did not belong to Aarushi’s room.
No DNA has been generated from the items belonging to Hemraj,like his bed sheet ( which bore his blood stains),T-Shirt, vest, undergarment and wristwatch in his room, or from his blood stains on the staircase to the terrace yet.
The website www. Sify.com has added further that as per the statement of the Forensic expert, Dr.BP Mahapatra , based on a letter from CBI, the finding of the partial male DNA on Aarushi’s pillowcover is suggestive of specks of Hemraj’s blood in the pillowcover in Aarushi’s room, that were not discovered earlier- one of the missing gaps in the proof against Rajesh and Nupur Talwar in the Aarushi- Hemraj murder case – and so,suddenly, the CBI’s presumed sequence of events falls into place, like a breakthrough, viz. the presence of the male servant ( Hemraj) together with Aarushi in her room that night when the murderous assault began.
Another report says that a pillowcover with Hemraj’s blood was found in Hemraj’s room,so the matter under dispute now is the place from where the pillowcover is recovered, as one pillow cover cannot be obtained from two places.
It is also said in the forensic report now that female DNA has been recovered from a blood stained blanket on the terrace of Talwars’ neighbours, which was not mentioned before in closure report.
The latest news is that ‘faint blood stains’ and female DNA of Aarushi has been found on the clothes of both the parents,whereas, the earlier Forensic report had mentioned that only Rajesh Talwar’s clothes revealed Aarushi’s bloodstains.
P) CHANGE OF CBI APPROACH:-
Seeing the way the Forensic experts investigating this case are making an almost total somersault,and claiming to have made fresh incriminating findings against the Talwars from articles, that were denied by FSL authorities earlier, it is hoped and trusted that the CBI is not fabricating new evidence,or transplanting their earlier findings on items that were lying elsewhere.
For example,the same ‘mixed up’ sample of pillowcover with Hemraj’s blood that was found in Krishna’s room in the beginning (exhibit No of which is not stated ),may be the one they now claim to have recovered from Aarushi’s room,as the Item under caption no. 13, (the source of which was not mentioned in the first list), by interchanging the exhibit numbers, to make and justify statements in contradiction to their own foregoing statement that there was no male DNA in any of the pillowcovers in Aarushi’s room, just to win the case.
This suggests a vindictive motive on the part Of CBI to prove the Talwars,particularly Nupur guilty, because she has challenged the veracity of all the investigating agencies,including their own closure report,and forced them to resume the search for Aarushi’s real murderer/s.
Well, they did resume the search, and accused the one whom they have come to see as the ‘real’perpetrator of the murder- Nupur Talwar ! For in their eyes, her opposing the closure of the double murder case and demanding reopening of the case on the basis of lack of sufficient investigation and evidence to label the Talwar couple guilty of their daughter’s murder, after having tampered with the evidence themselves, is like ‘Chori Aur Uparse Seenazori.’
Even after that experience though, which Nupur calls ‘shocking,’she does not seem to have become any wiser,and continued to be unco-operative and defiant, dodging the CBI court summons to appear for the hearings till she was given an ultimatum to surrender,which is why the CBI is distrustful and reluctant to release her on bail now. So, in a sense, she herself has invited her present fate.
Nevertheless, in the interest of justice, it needs to be ascertained from where the pillowcase with the blood of Hemraj, which was found in Krishna’s room first, came- from Aarushi’s or Hemraj’s room, and whether it is the same sample declared by CBI to be ‘mixed up’, on the basis of which Krishna has now been acquitted as ‘ not guilty’, that is the Item No. 13,presented before the CBI Court now.
Nupur’s lawyer, Pinaki Misra, had stated before the court that the pillowcase said to be found in Krishna’s room can be submitted for forensic testing even now , for finding out the truth.
Hence Number 13 appears to be inauspicious for the Talwars, particularly for Nupur.
Now, there is a report from the Sify News website that the CBI has admitted that AGL Kaul, their Addl. SP, has been sending e- mails to the Talwars as well as to their advocates and friends under the disguised email Id / address in the name of the deceased man Hemraj , as Hemraj Singh,(hemraj.jalvayuvihar@gmail.com)for official communication, for reasons best known to the agency itself. If it is true, it is shocking !
If the CBI -the topmost investigating agency of the country , is really stooping to such treacherous methods to prove itself right and competent,it is shameful,and alarming for the common man!
The Agency is playing such underhanded games to win this case, which they have turned into a prestige issue,that soon a time may come when the general public will begin to feel that the present team of CBI too, along with Hemraj Singh / Kaul, should be replaced at once.
BUT, the question is,who will bell the Cat ? Already, the Talwars are paying the price for getting the first investigating team of the Noida Police replaced by CBI through Mayawati.
Still, it is worth finding out why the earlier team of CBI, of Arun Kumar,Noida SSP Satish Ganesh and Meerut IGP Gurdarshan Singh, that was appointed by then UP CM Mayawati,
was replaced soon after, by the present one,which has come up with a theory of the crime and culprits totally different from that of the previous one.
Is it because the findings of the previous team and their action of arresting the above mentioned servants, had started becoming uncomfortable for some top police officials or any other Big Shot/s (like the Durranis or Dinesh Talwar?) or did it happen because the Talwars themselves complained against them for their disrespectful comments about their character and that of Aarushi Talwar ?
It is notable that the findings of the present team are similar to those of the Noida Police, who had arrested Rajesh Talwar.The next team,i.e the first team of CBI,had named and arrested the three servants-Krishna, Rajkumar and Vijay Mandal as suspects,whereas the present team has let all the three off in spite of significant findings against them,and are focussing on the Talwars, particularly Nupur.
The prejudice against Nupur becomes all the more obvious and obscure with the CBI’s insistence to keep Nupur incarcerated in the jail even after 3 1/2 months under the excuse that if released at this stage,she might abscond or tamper with the evidence, besides exerting deleterious influence on the other people connected with the case, viz. Witnesses among their employers, friends etc, For, at the same time , there’s no hurry to terminate the longstanding bail of Rajesh Talwar,who is a coaccused in this case, and who has actually been charged with one more offense,viz lodging a false FIR against the dead and temporarily missing man Hemraj, while refraining deliberately from cooperating with the police in opening the terrace door in spite of the Noida police asking him.
This smells of a conspiracy selectively against Nupur, though the exact reason or nature of it is not known.
I think it is like this- Nupur Talwar accused the Noida Police of having ‘framed’ Rajesh Talwar.
Then the top Police officers of the first CBI Team were also transferred shortly and abruptly midway between their investigation following the complaint that they made remarks that ‘defamed’ the character of Rajesh and Aarushi.
So now the present CBI team has framed Nupur, to ‘ tame’ her!”
So much so,that one now feels inclined to ponder over whether the Talwars’ step of getting the CBI closure report rejected by the Court (till which time Rajesh alone was deemed as the main culprit for the murders, and Nupur had remained practically untouched), was a wise or suicidal move on the part of Nupur Talwar !
Nevertheless, one has to acknowledge that they HAVE managed to save the honour of Aarushi all right, however they may have done it, with the help of Dinesh Talwar possibly,in view of the latest report of the Forensic Expert that no evidence of sexual assault could be established on the basis of her vaginal swab samples.
However, it should be remembered that the failure to establish sexual assault on the basis of the available items of suspicion, and the results of tests conducted thereon, does not by itself prove that no such assault has occurred, especially when the samples are contaminated or swapped with someone else’s. It only indicates the investigating agency’s failure to prove the assault for the purpose of conviction, and deciding whether and what penalty can be imposed upon the suspects in the case. So, from that angle, the possibility of Aarushi having been raped before murder,still remains, whoever may have done it, and whether the culprit can be punished or not !
It is dreadful to think of what may have happened really to the poor girl that night, who may have done it, and more than anything how Aarushi may have felt during those last moments, when someone, probably well known to her, came through the open door like a nightmare, and took her honour and then her life. As Shobha De has written,” Poor Aarushi”!
The next question however brings us back to the same point- if no sexual or objectionable intimacy had occurred between Aarushi and Hemraj ,then what else could be the motive for the Talwars to kill their only child ? Also, only Aarushi’s blood stains are said to have been found ,first on Rajesh’s and now on Nupur’s clothes too, but Hemraj’s blood has not been found on either of them. Then,who killed Hemraj ? And, if Rajesh hasn’t done it, why was he hesitating to openthe terrace door on the first day before the Noida Police ?
Also, it has still not come to light who took away the items of evidence related to Hemraj’s murder from the terrace. Wonder whether they were removed by the Killer immediately after his murder on 15/5/08 night itself, or after the terrace door was opened on 17/5/08 morning under the supervision of DINESH Talwar, KKGautam , Dr.Sushil Choudhary and the Noida Police ? If it was by the police,who opened the door that day but are not able to produce the same before the court or offer any explanation for their disappearance now, just transferring them is not enough.They should also be held accountable for the lapse and charge sheeted.
It may be Rajesh had hired someone to kill Hemraj alone,thinking that he could pass it off as a result of a fight between the servants themselves, in which he was not involved; but unfortunately, Aarushi too got killed accidentally along with Hemraj, which gave him the idea of getting Hemraj’s body taken and hidden on the terrace, and disposing of his body secretly later, so that he could blame the dead servant himself for Aarushi’s murder and divert the attention of the police outside the house,and thereby away from the actual killers, who, he feared, might expose him, if named.
However, considering that the Talwars took the risk of themselves being implicated in the crime , in the event of the murder case being reopened on their demand, and demanded the ‘Touch DNA’ test to be done on the prints on the Whisky bottle, so confidently, which only people who have some truth on their side can do,there does seem to be a probability that one or more of their own servants, or Durrani’s servant Rajkumar, singly or as whomsoever’s accomplice,(perhaps of Dinesh Talwar, who might actually have come there for Hemraj ), might be the real murderer/ s of Hemraj and Aarushi after all !
Rajkumar is said to have told the CBI during his interrogation by the police that on May 16, 2008, Dr. Talwar called him and asked him to wash all the blood soaked clothes, and to serve water to the guests. The implication of this is not clear. Was he taken into confidence and asked to do the chores because he had already participated in the murders and was in the know of everything ?
(Really, this case is beating all the current fictitious serials like CID hollow , in the interest it has aroused in the people of this country and perhaps of other countries too,who have been following up its progress avidly).

The latest news today is that Nupur Talwar, the mother of the murdered teenager Aarushi, has been granted bail by the Supreme Court at last. However,she would be released on 25.9.12.
Two of the initial list of 13 material witnesses have been dropped, for one of them, Talwar’s earlier domestic maid servant Kalpana Mandal, who had gone on leave for a week before the murder, and then left their job after her return to start working at the house of Nupur’s parents, was supposed to have been’ won over’ by the Talwars, judging from her reticence to cooperate and give information to the CBI.
CBI questioned the driver Umesh Sharma about Talwar’s golf sticks again, and then presented their witness Laxman Singh for cross questioning of Umesh Sharma, as he was present when Umesh handed over the golf sticks to them.

Finally, Nupur Talwar has been released on bail today, evening of 25-9-2012.and it seems that the CBI has been able to call back Sanjay Thakur who was also there at the time of handing over of the golf sticks to CBI.So, Nupur is back finally, but the pity is that Aarushi and Hemraj will never come back to get justice!

‘ The Closure Report could well be an attempt (by CBI)to save those whose support is vital to the survival of the UPA.’- Says a quote from a report by the newspaper Deccan Herald,dated 28.9.2012.
Who are ‘Those ‘? Krishna, Rajkumar, or Dinesh Talwar ? Krishna by himself was just a compounder in Rajesh Talwar’s clinic, and Rajkumar,only the Durrani’s domestic servant; so it’s not understood how they could be important for the UPA. Yet, seeing the way the CBI is shying away from probing deeper into their connection with the Double murder case,and playing down or denying the hitherto obtained evidence against them,one is forced to suspect that some big figure is shielding them for whatever reason. Time only will tell what, or WHO it is.
CBI asked for court permission to obtain and submit some more documents in support of their case, which they had not submitted to the Court before, either during the current proceedings or earlier, with their closure report. The defense council rightly opposed this application of CBI, and asked them why they had not filed all their papers together, before this.
It is a matter to be noted that the report of the CDFD Lab., Hyderabad, dated Nov. 6, 2008, about the bloodstains on a pillowcase sent by CBI to them, had declared the same to be of Hemraj,and obtained from Krishna’s room. Afterwards, following some correspondence with the CBI, in which the CBI mentioned that the point escaped their attention ‘through oversight’,the same Lab has inexplicably stated by a letter of corrigendum dated March 24,2011, that the report was the result of a ‘typographical error’,of mixing up and exchange of reports of two samples Z14 and Z20 with each other. Is it not strange, or rather, is it believable that a top laboratory like theirs would issue a report in relation to a murder case without checking for ‘ typographical’ errors first, and that too a vitally important one, on the basis of which the onus of a murder was going to shift from the previous suspect, the Talwars’ servant Krishna to someone else,i.e. Rajesh or Nupur Talwar ,themselves,to be specific.
What is not clear is that the sample of the pillowcase said to be from Krishna’s room was sent to CDFDLab, Hyderabad, on June 4,2008, and the letter of clarification about mixing up of the two samples, is dated March 24,2011, i.e over 2 yrs. after their initial testing report of November 6, 2008. If there was a mistake in reporting, that should have been corrected immediately,and by CDFD Lab ‘on it’s own,’soon after the first report of the samples, in 2008 itself. Why was the correction done and informed by CDFD so late as on 24 th March 2011,and only after closure and reopening of the case in December 2010, i.e. after clarification about it was sought from them by CBI, in the beginning of 2011, for presentation to the CBI Special Court? For, the CBI had already informed the court on 18th March, 2011, about the ‘juxtareporting by mistake’of two samples sent to the CDFD Lab.,’ before the receipt of that Laboratory’s own letter of correction,’to CBI, informing and submitting apology for the inconvenience caused by the erroneous report !
Actually, before allowing that letter of CDFD,Hyderabad, to be submitted and taken into consideration as a piece of evidence in favour of CBI’s stand in the case, the CBI Trial Court should have first called the scientist from the said Lab, who did the testing and reporting of the controversial sample, to appear personally before the court, and respond to the questions of the Defense Counsel, for clarification about the ‘retrospective rectification of the typographical ( or hypo- thetical/hypocritical ?) error’ contained in their earlier report. For the corrigendum obviously seems to be a product of purposeful concoction or ‘tutoring’,by whomsoever concerned, with underhanded and malicious motives, tantamount to ‘ Hitting ‘ the Talwars ‘below the Belt’ !
The Trial court asked CBI to submit their application before it,for the court to examine the relevance of the additionally required papers to the case, and admitted the papers on 29.9.2012.
However, at this point ,it has begun to appear that it is the CBI officials,rather than the Talwars,who are attempting to manipulate the earlier investigation findings and reports to ‘win the case’ against the Talwars, instead of remaining a neutral agency helping the Law to do justice, which is deplorable.
One more possibility remains, nevertheless,if one wishes to give CBI the benefit of the doubt, that it may be that before the closure report, the agency assumed, unquestioningly, the innocence of the Talwars on the Prima Facie basis of their being the parents of the murder victim Aarushi, and investigated the case with that positive bias in their favour, and submitted the closure report without recommending any punishment for them, for the reason that there was no definite evidence for charging them. And Nupur was not framed for the murder at all. In fact, she was let off without spending a single day in jail; but probably, it was that very initial leniency of theirs that encouraged the Talwars to protest even against their being just mentioned as suspects in the closure report without mention of any suggested action against them, and ask for rejection of the closure report, and reopening of the case to trace the ‘actual’ killers, thinking that they can redeem themselves in the eyes of society by doing so, but have landed in deeper trouble thereby.
For, this step of theirs has turned the bias of the CBI against them, as the agency had to suffer reproach of the court and acute embarassment on account of these same persons whom they were trying to shield till now, and made them decide to teach the Talwar couple a lesson by initiating a ‘real’ investigation against them hereafter.
However, this sudden ‘ U- turn’ of their attitude is making their changed, and perhaps right, approach look like prejudiced and vindictive inquiry at this stage, thus turning the sympathy of the majority of people towards the Talwars instead, who may or may not have committed the murders, but definitely seem to be more concerned about protecting their own social status ( from the way in which they sought to prevent reporting of proof of sexual exposure, consensual or forced, of their daughter, by trying to persuade the retired DSP KKGautam to intervene and influence the doctor doing her postmortem to expedite the performance of the PM, and withhold any evidence of rape, as well as by exchanging her vaginal swab samples with another woman ), than getting the culprit/ s,- if they themselves are innocent- ,caught and punished for the murder of their only child, by allowing and helping the investigating officers to find out ‘ the truth ‘. But, what is the truth ?

Now, it has been discovered by CBI, (though as usual, denied by the Talwars ), that their Internet was in use off and on,at about two hour intervals, throughout the night of 15/5/08 upto 1.11 p.m. On 16/5/08, I.e.after the Router in Aarushi’s room was switched on, at 11.00 p.m on 15 th night, it remained on till about 12.08, after midnight. Then, it came on again at 2.04a.m on 16/5/08, and was switched off at 3.43 a.m; put on again at 6.05 a.m and remained on till 1.11 p.m that afternoon.
The Talwar’s counsel has refuted this statement, arguing how they could have used their Internet, with Police and family members around them since 7.00 a.m that day, on account of Aarushi’s death. However, considering that the police had not seized their computer/ laptop that day, there was nobody to prevent them from using it then, and during the preceding night. They may even have taken the laptop with them to the Govt. Hospital , when they went there for Aarushi’s PostMortem.
For the ‘skeleton’,I.e. body of Hemraj was still in their ‘cupboard’, the terrace then,and Rajesh and Dinesh Talwar must be wanting to do some last minute homework,as also contact some trusted folk to think of ways to dispose it off surreptitiously at the earliest opportunity before that. However, fortunately or unfortunately,they couldn’t do so, as the Retd.DSP KKGautam played the spoil- sport and broke open the terrace door the next day, 17/5/08, suspiciously,on request of Dr.Dinesh Talwar and his friend, Dr. Sushil Kumar Choudhary, in Rajesh’s absence.
There is said to have been an effort made by someone to change the passwords of Aarushi and Rajesh Talwar around 19/5/08,two days later, presumably just before the late Jagbir Singh Mullick, the first investigation officer in the case,came and seized the computer. No manipulation was attempted to change Nupur Talwar’s password,though she too was at home that night, which is why her role in the matter seems to be less dubious in the case than of Rajesh to me.
It is not known whether working of theRouter 1-2 days before, and 2-3 days after the murder, I.e. till the computer was seized , has been tested for erratic switching on and off, for in that case, it would be clear whether their router was behaving ‘whimsically ‘ from a few days before the murders,(in which case, there is a ground for believing that the Router was not functioning properly), or only on that day, the night of 15/5/08.

Now, the latest development is that Dr. Naresh Raj, who did the Post Mortem of Hemraj, has gone missing too.
His wife, Dr. Ritcha Saxena, the Pathologist of the Laboratory in which Aarushi’s slides were contaminated and mixed up or exchanged with another woman’s ( Nupur Talwar’s?) samples, has not been enlisted as a witness,strangely.
Before this also, some witnesses were reported to be ‘ untraceable’. How and why?
There are two possibilities:One- the missing witnesses, most of whom seem to be pro- Talwar, are absconding or are hidden away by the Talwars , to save them from the awkward position and ordeal of appearance and compulsion to reveal some antiTalwar facts during cross examination before the CBI Court.
Or else,the CBI Agency itself has seen to it that they do not come before the court and weaken the CBI’s side by vouching in favour of the Talwars and their innocence in the double murder case.
Thus,’ The Mystery of The Double murders’has turned into the ‘Mystery of The Missing Witnesses’now.One need not be surprised if tomorrow it becomes ‘The Mystery of the Missing Records of The Aarushi- Hemraj Murder Case’!
UPDATED: 22-11-2012:-
Now, the CDFD, Hyderabad, has reported that (1) The vaginal smears sent to them do not contain the DNA of Aarushi, but of some other woman, whereas the DNA of Aarushi has been found in the samples collected from other items from her room;
(2) The DNA of none of the suspected servants has been found in the samples collected from the Talwar house;
and (3) and the ‘mix up’ of the numbers on the labels of the two pillow cases seized from the rooms of Hemraj and Krishna has been confirmed and rectified, as desired by CBI, with the explanation that it was obvious that there was a mix- up in the labels of the two pillow cases, as the articles supposedly taken from Hemraj’s room showed the DNA of Krishna, and those from Krishna’s room bore the DNA of Hemraj. It is significant that only the sample that could pinpoint the offender, has been exchanged !
With due respect to the Talwars, there is one doubt that comes up my mind with reference to the last report regarding the pillowcase with Hemraj’s blood, supposedly recovered from Krishna’s room, but now said to have been taken by the first investigating party of CBI on June1,2008, from Hemraj’s room itself – It is understandable if Krishna’s blood was found on the pillowcase in Hemraj’s room, for the latter’s murder took place in Talwars’ house,and so,Krishna’s blood, if he is the murderer, could have come onto Hemraj’s pillow during the fight between them; but his DNA has not been found in the Talwar residence.
On the other hand,it is not clear how Hemraj’s blood could have come onto the pillow in Krishna’s room, unless he brought it home with him. However, even though he might have brought it to his room, it is not conceivable that he would keep an evidence of murder, likely to implicate him in the crime, in his room, that too,without washing it properly,for 16 days,from May 16 to June 1,2008, till the CBI and Forensic specialists raided his room.
Besides, he was a friend of Hemraj and used to confide in him in all matters,including’ the fact that he was angry with, and wanted to take revenge against Rajesh Talwar, their employer.Hence, it is unlikely that he would want to attack or kill Hemraj without any big grievance against him, unless any fight took place between them over Aarushi that night.
So,may be the CBI is right in respect of the pillow case mix up matter, after all !
However in view of the clarification by CDFD about the exchange of pillow covers, that the one with Hemraj’s blood and DNA is Hemraj’s only,and from his own room instead of Krishna’s,and the other being from Krishna’s room,then whose blood is there on the pillow that was supposed to have been taken from Hemraj’s room but now, after the ‘correction, said to be from Krishna’s ? the Sify.com article” If the Talwars didn’t do it, who possibly did?”says that this,”Krishna’s pillowcover contained blood, but it wasn’t clear whose.”!
Further,the Sr. Scientist from CFSL, Hyderabad has stated his inability today to specify whether the blood stains found on the staircase leading to the Talwars’ terrace were imprinted there on the night of the murders,viz.15/16-5-2008, as the CBI believes, Or came there the next day, when the bloodstained mattress and bedsheet of Aarushi were dragged upstairs for depositing on the neighbour’s terrace, as per the claim of the Talwars’Defense counsel.
The CBI also alleges that the cellphones of the murder victims were with the Talwars only.
So it is clear where the case is leading to. The CBI is bent on proving Dr. Rajesh and Nupur Talwar guilty of the murder of Aarushi and Hemraj, to the exclusion of involvement of everybody else,including their driver Umesh Sharma, who had visited the Talwar household as late as nearly 10.00 o Clock on the night of 15-5-2008,and particularly Krishna Thadarai, Talwar’s Compounder, despite his initial confession to the police and CBI Officials of his being present at the site, when Rajkumar raped Aarushi. Probably, the CBI has taken Krishna on their side by persuading him to become the Government witness in return for pardon. Or, Krishna and Rajkumar are enjoying the patronage of some powerful and influential person.
So the Defense counsel of the Talwars have taken the right step in demanding that the records of the Narco, Lie Detection and PolygraphTests done on the three servants, Krishna, Rajkumar and Vijay Mandal done by the CBI, as also the Work Sheet of the CDFD, Hyderabad,should be produced before the Special CBI Court on Nov.24,2012,and that the Letter ofCDFD, Hyderabad, dated 24-3- 2011 to CBI,rectifying ( ?) their previous report of Nov. 2008, should not be permitted to be submitted before the CBI Court as subsequent evidence in support of Krishna’s innocence at this late stage, after the CBI has once closed the case.( Though, the present team of CBI attributes the failure of Krishna and the other two servants to pass the Narco and other tests to the leading efforts made by the previous CBI agency team to ‘put words in their mouths’!)
But then, the Talwars themselves urged for reopening and resumption of the case, which was a big mistake, for now, the CBI will also be justified in trying to get some documents reviewed and rectified if necessary !
Already, the case of the Talwars has been weakened by the CDFD report that the servants’ DNA has not been found in any of the items collected from Talwars’house.
It is not known whether the DNA in the blood stains on the walls of Aarushi’s room and outside her door, said to be of a male, has been matched with that of the terrace staircase,palm imprint on the wall, and the Whisky bottle; the servants and also the Talwar brothers, as that too could give some clue about the killer’s identity. In fact, this should have been done already, unless the CBI does not want to be faced with truth that may put them in a difficult position.
Coming back to the CFSL report,Puneet Tandon, his right side neighbour,of Flat no, L-28, has stated during the investigation that Dr. Talwar has exclusive access to his staircase.
Considering that the friends of Dr.Rajesh Talwar, viz. Dr. Rohit Kochhar and Dr. Rajeev Kumar Varshneya, who visited Talwar’s house on 16-5-2008 morning ( before Aarushi’s mattress and bedsheet were taken upstairs to the neighbour’s terrace ),mentioned in their first statements to the investigating officers that they saw blood stains on the Talwars’ staircase going upto their terrace door, and that Forensic experts detected Hemraj’s blood in them, which matched that on the Whisky bottle and the DNA profile generated from the Palm imprint on the terrace wall,
it seems more likely that the blood came there on the night of the murders, from Hemraj.
If the DNA from the palm imprint on the terrace wall is said to be matching with with Hemraj’s, it means that Hemraj was attacked after reaching the terrace, by whomever took him there, because of which,he placed his hand on the wall to save himself from falling, after which, he was dragged to the middle of the terrace and slain there. However, some injury must have occurred before reaching the terrace, in view of the blood stains found on the way up there.
It is not known whether the blood stains of footsteps on the staircase to the Talwars’ terrace have been matched with the stains of the footsteps in Aarushi’s room.
That Dr. Kochhar fumbled in the CBI Court later, over the question of whether the stains were of blood or red paint, appears to be a result of pressure on him or emotional blackmail by someone. For surely , a medical doctor with many years of practice, cannot be incapable of such a basic judgement as differentiating between human blood and red paint , ESP in view of the fact that Dr. Rajeev, who was with him, had asked the Noida Police Officer present there,to open the door then itself, as he thought the stains on the terrace door latch were of blood, but that the policeman ignored his suggestion and just peeled ching the terrace off a little of the substance on the door, and left, saying that it may be just rust.
I feel that Jeevan Sharma, son in law of Hemraj,i.e. a close family member of his,and also working in the clinic of Rajesh Talwar, should be interrogated more deeply and in more detail than has been done to get some more clues and guide lines to pursue the case.For it is possible that he is concealing facts for fear of being implicated in the case,or is afraid to reveal all that he knows out of fear to his own life from the perpetrators of the murders of Aarushi- Hemraj, who perhaps may be behind the mysterious death of Raju,alias Nimraj Kaushal, the earlier domestic servant of the Talwars too.
Now, the trial has come down to the CBI backing Krishna and the other two servants on one side vs. Rajesh and Nupur Talwar on the other. However, the fact of one party being guilty does not prove the innocence of the other. It has begun to appear that both sides, particularly Rajesh,and may be Dinesh Talwar, their friend and cousin Dr. Ajay Chaddha,Who helped Nupur to find the main weapon of murder,viz. the golf club,theDriver Umesh,and Hemraj too,maybe involved in the double murder, but the CBI seem to be striving to put the noose only around the Talwar couple’s neck, for whatever reason, which is very wrong and unfair.
As for the Talwars, they still stick to their contention that Krishna killed Aarushi, as he wanted to take revenge against Rajesh Talwar for having threatened to sack him from service.
According to the infamous convict, Charles Sobhraj, who was asked for his opinion,however, it seems to be a murder prompted by jealousy of one of the men who were interested in Aarushi. So,perhaps,it may be Hemraj himself,who did it out of jealousy on account of her intimacy with Anmol Agarwal, about which he is said to have been blackmailing her, and then cleaned and tidied her body and bed. He only might have changed her dress also.
It is not clear however, who killed Hemraj. The Talwars say they suspect Compounder Krishna, Rajkumar and Vijay Mandal, esp. the first two, to be behind it, possibly due to some personal fight between them over money, liquor, or Aarushi- in other words, Wine,Wealth and Woman !
However, one thing is still unclear. It is learnt that the milkman who used to supply milk to the Talwars had called on Hemraj’s cellphone to inquire why no one had come to fetch milk from their house that day, and that someone else replied that milk was not required that day. Who spoke on that phone to the milkman that night, of the murder ? If it was Rajesh Talwar, it means that Hemraj’s and probably Aarushi’s mobile phone, both were with Rajesh Talwar only.
The parents of Aarushi had counted on the pillowcase with Hemraj’s blood and DNA,found in Krishna’s room, and the reports of Narco and other tests done on the servants by the first team of CBI, wherein the first two men had supposedly confessed their involvement in the double murder,
as a solid proof in their favour, but with the ‘rectification’ of that DNA report by the CDFD, Hyderabad, that point has been annulled. On top of it, the CBI Court has rejected their appeal for the submission of the reports of the Narco and other tests, and worksheet of CDFD, Hyderabad,
for reasons not understood, on 3-12-2012.
Rajesh and Nupur Talwar’s clothes have been reported to be bearing Aarushi’s bloodstains and DNA on them, but not Hemraj’s blood .So, that mystery still remains.The Driver ,Umesh Sharma is the last person who saw the whole family and Hemraj together and alive on 15-5-08 night at the Talwars’ residence, so he too, should be treated as a suspect in the case and interrogated more deeply,but he has been acquitted, only because he is said to be a loyal employee of RajeshTalwar.
What is noteworthy is that Rajesh Talwar had also confessed to the murders during the initial interrogation and tests, before CBI. If he really didn’t do it, why did he make the confession? That means that he IS guilty of something – either committing the murders,or getting them done through someone else, may be because Aarushi and Hemraj, by their spying on them, and ESP. Aarushi , by quarrelling with Rajesh over his liaison with Anita Durrani, and threatening to expose him before their family, had probably brought his affair to a breaking point.
I now think that even if Rajesh is the culprit, it is not likely that the reason for his murdering the two was because of finding Aarushi and Hemraj, engaged in a sexual relationship,as some people say, and as Rajesh himself may have said during his confession, ( though she might be having that kind of relationship with her friend Anmol, as she had definitely not remained a virgin ).For if she had been linked with Hemraj clandestinely,he would have come to know of it earlier,and could have sacked the servant long ago.
Also, it is reported that Hemraj had gone to a social worker four days before his murder, when he seemed to be very frightened of something, though it has not been clarified of what or whom. A servant in that state of mind wouldn’t dare to enter, or call anyone to enter, the room of his master’s daughter at that time of night and misbehave with her while her parents were at home, and just gone to sleep in the room next to their daughter’s, particularly when it was quite possible for him to have the girl all to himself during the daytime every day. So, the real reason must be for Rajesh to get the two out of the way of himself and Anita Durrani before they could make the situation embarrassing and difficult to the extent of making it impossible for him to continue his affair.
It is likewise not understood what meaning to draw from Krishna’s confession to CBI under narcoanalysis, as reported by that team, that he brought Rajkumar and another man named Shambhu, to Talwar’s house for taking advantage of his beloved daughter Aarushi, to take revenge against Rajesh for scolding and humiliating him before patients by threatening to sack him for some mistake, and witnessed Rajkumar trying to rape Aarushi, and Krishna himself killing her and Hemraj when they resisted.
In my opinion, it is almost certain that (1) Aarushi was clandestinely involved with Her friend Anmol since long, and was not a virgin, so Hemraj was probably jealous, and was blackmailing her for it;
(2)Probably,She was killed by her father Rajesh Talwar only, seeing the very short time,(after12 .08 at night and by 1.00 a.m, on 16/5/08, i.e. hardly 3/4 th of an hour),between his leaving her room after finishing his work at her computer – till which time no outsider could have entered his house without his knowledge -and murder her.
For, firstly,after completing work at the Internet and putting off the computer in Aarushi’s room,
by the time he went to his room and got down to sleep, after taking drinks and swallowing sleeping pills,(as he says), it must have been past 12.30 at night before he fell so fast asleep as not to be able to hear any strange and alarming sounds like his daughter’s dying screams,or struggle.
Because,it takes at least 15 minutes or so, for the drinks and tablets to start acting and exert their full effect. It is not like cyanide, which makes one drop down the moment it is put in the mouth !
It is also not feasible that some outsider got a ‘flash of clairvoyance’ immediately thereafter, that the ‘door of Aarushi’s room would have been left open by mistake that night,’and rushed into his house at once to kill his minor daughter for no good reason, Unless Hemraj noticed the open door, and instead of going in himself, called Krishna, (who might have briefed him beforehand about his plan to take revenge against Rajesh by raping Aarushi,or getting her raped by Raj Kumar, who had an eye on her, and asked Hemraj to inform him as soon as the opportunity arose, so that he could come at once with Rajkumar,as his accomplice).
Still,the possibility of someone having come in after 12.30 that night, drinking liquor, trying to rape Aarushi;then, murdering her along with Hemraj,dragging and locking Hemraj on the terrace, cleaning the body and bed of Aarushi , and then leaving with their mobile phones after locking the main door- all within a span of merely 30- 35minutes- like “He came,he killed and he left “,without leaving any evidence of his commitment of the crime,is very unlikely. The watchman and neighbours also say that they did not see anyone coming to Talwar’s house, or leaving therefrom that night.
About the bottle and 3/4 glasses of wine in the room of Hemraj, that could very well have been planted by Rajesh himself to give the impression of intruders,as none of the servant’s fingerprints or DNA have been detected in Rajesh Talwar’s house. All that is found is, the victims’ blood, and, some ‘unidentified’ fingerprints on the Talwar’s Whisky bottle on the dining table, probably obtained from some confidant among the early visitors to the Talwars’ house on 16.5.08 morning, before calling the police.
Hence, Rajesh appears to be the one to have murdered Aarushi, the motive of which was probably to prevent her from trying to stop his affair with Anita Durrani; this is suspected from the attempt made by somebody, probably Rajesh, to change the Internet passwords of Rajesh and Aarushi barely three days after her murder, to avoid the investigating Police Officer Mullik reading the contents of the communication of Aarushi and himself, with each other, and with outsiders.
Therefore, the case seems to be one of ‘ Honour Killing’ all right, but it was not due to any attack or threat to Aarushi’s honour, but due to Rajesh Talwar’s own honour put to stake by Aarushi and Hemraj !
It is said that such murders occur either as ‘Honour Killing’. Or as a crime of Passion, a result of extreme frustration and hatred. In my opinion, there is a combination of both these factors operating in the present case.
(3)Hemraj seems to have been killed by someone else, for some obscure reason,as his blood was not there on Rajesh Talwar’s clothes; but both murders were committed within the same short period of 12.00 midnight and 1.00 a.m. So it appears Rajesh must have got Hemraj also killed,through an accomplice, whom he himself called over, and took into the house for his help – Who it was, Driver Umesh, Krishna or Rajkumar, remains to be found out.
However, with due respect to the CBI and CBI Court, it has to be said that , on their part, they have used their authority high handedly to manipulate facts and dealing officials for getting the unwarranted, retrospectively corrected report of 24-3-2011 from CDFD, Hyderabad, about the claimed mixing up of the servants’ pillow DNA reports, (which is the main point on which the contest rests at this stage) and to crush the Talwars’ Right To Information, by not passing the order on Nov. 24,2012 about the Narco test reports of the staff. It is these underhanded tricks of CBI which invokes doubt about their bonafides, and about the role of the compounder Krishna, (whom they are obviously trying to protect for some reason) in the murder of Aarushi and Hemraj.
All said and done, I have still not understood one thing, that is, why Hemraj did not leave the service of Rajesh Talwar while there was time, or run away, when he was obviously scared of something four days before the murders, and he phoned and told his wife that he was afraid of being killed by Rajesh Talwar. I can understand Rajesh not removing him, as he must be afraid of Hemraj going and telling outsiders about the private matters of his family, but Hemraj’s staying on is mysterious.
May be he stayed on because of Aarushi’s pleading.
By the way, it is learnt that Raju alias Nim Raj Kaushal, Hemraj’s first cousin,who was working as domestic help at Talwar’s house in place of Hemraj was also killed in a road accident. The police said he died due to his own reckless driving on his mown motorbike, but people around said that he was hit by a speeding car mysteriously, when he had got down to buy cigarettes.His body was found in a nearby drain.His phone too remained active till next day. He too was afraid for his life, so the name of the owner and driver of the car that had hit him should be traced. The quest might end at L-32, Jalvayu Vihar, Noida ! However, it is surprising that no one claimed hiis body,
not even Hemraj !Why?
FINAL CONCLUSION:-

Now, finally, the CBI Court has brought it’s axe down on the parents themselves,Rajesh and Nupur Talwar as the culprits – for the double murder of Hemraj and Aarushi, and for concealment and destruction of evidence of the double murder!
In addition, Rajesh Talwar is also guilty of lodging the false FIR against Hemraj on 16. 5. 08, the day of the murder for the murder of Aarushi and absconding, thus misleading police investigation.
To begin with, Dinesh Talwar was also named as a suspect, as it is he who
(1) Approached the Retd.DSP KKGautam, to request him to instruct Dr. Dohare, who did Aarushi’s Postmortem,on 16.5.08,to do the PM soon, and avoid mentioning ‘Rape’ in his report; he also contacted Dr.Dohre personally for the request;
(2) He also brought over KKGautam to get Rajesh’s terrace opened through him,but Gautam called the UP Police and got it opened officially, on 17.5.08, when Hemraj’s body was also found on that
Terrace!
Since CBI count these actions also as a default, they did not list Dinesh as a witness, saying that he was on their suspect list, but subsequently let him off scot-free without any investigation, probably because of his political clout with his colleague and friend, Dr. Sushil Kumar Choudhary, who in turn,was a friend of KK Gautam.
The Talwars will of course appeal to the higher courts against the verdict, but it doesn’t look as though they will meet with success there, as they have already antagonised all the courts against themselves!
It is hoped that the Higher Courts at least, will consider the version of the first team of CBI, which is supported by Nalini Singh, Sr. Journalist, in the interest of justice!
Rajesh can now only try and pray for the ‘minimum penalty’ to be imposed upon him and Nupur, by pleading for mercy, on the basis of the clause in the CBI Report,’Grave and sudden provocation’ for the murder!
So,Dinesh Talwar, Krishna Thadarai and all the servant suspects in the case,and Umesh Driver,
or the real murderer/s, whoever you are, and CBI, Relax now and Rejoice! The Ghost of
the Aarushi- Hemraj case will no longer bother you! For the Noida Police have done a good job
of destroying whatever evidence there was by their haphazard way of investigating the case,
on the first two crucial days of the investigation!

I will be still happier if my blog can make any contribution to get poor Aarushi justice, as well as her honour ba k. About Hemraj, frankly, I’ m notsure of his innocence yet ,I.e. whether he died while trying to protect Aarushi, or whether he got killed in the course of his fight with some others, to lay hands on her. I don’t know whether her parents played a part in her murder, but their utter failure to watch and protect her, as guardians of an adolescent girl living in a house with male servants, is 100% certain and undeniable.
I agree that the behaviour of Aarushi’s parents, their mysterious silence and the suspicious looking facts of the case, as mentioned by you compel us to consider the possibility that Rajesh and Nupur Talwar are involved in the double murder, even though they are Aarushi’s parents, for reasons only known to them. Yet,the CBI’s apparent efforts to extricate Rajesh’s compounder Krishna Thadarai, by seeking to modify the report of CDFD, Hyderabad, about a pillow and it’s case, supposed to have been seized from Krishna’s room, and found to have Rajesh Talwar’s servant Hemraj’s DNA, raises doubts about the CBI’s motives too.And it’s not as if the Talwar couple has been let off totally. They too have been jailed like the servants. So, to sentence them to third degree treatment requires more concrete evidence against them,over and above circumstantial proof. Anyway, today is 5th October,and the date of further hearing of the case in the CBI Court, so we have to wait and watch what comes out of it, for the time being.However, it seems peculiar that the CBI, who seemed to be hands in glove with the Talwars, ESP. Nupur, till their closure report of December 2010,till which time, Nupur was practically ‘ untouched’,has suddenly turned against them,since the reopening of the case, as if out of a personal ‘fall-out’between them for whatever reason.Let’s see, Aage aage hota hai Kya.
i respect the judgement, but if the case would be handed to a team of forensic expert. they must have proved the case in light of modern science along with circumstantial evidence and presumptions.

i didn’t know about this before i saw this movie trailer Talvar. I studied the whole case and its miserable. Even someone like me who never heard of this case, when read whats written on wiki, internet and see video, reports interview of whole crime scene and Talwar’s, can get this doubt that parents are killers. And when you see the parents sexual history records, that confirm whole story. Like swinging couples, marital affairs and objectionable words in email between girl and father. You can guess how liberal and rich talwars are, so for them to manipulate evidences isn’t a big problem.
But biggest mystery for me is not that parents killed their child but is that why do they have to kill her.
1. Because if their girl was doing sex with servant then they gonna kill or harm servant only, because when u see such a liberal couple who are so much open to their daughter, they don’t do honor killing. They can harm their child, take away everything from her and locked her in the house.Or they gonna try to make her understand that she is doing wrong and its not good for her. Thats what usually parents do, (educated parents: term has been used by talwar themselve).
2. When u heard about girl Aarushi, she like big stars, she have many male friends in her school and she was beautiful, young. If she have any sexual desire she can fulfill them with her friends or some other guys, smart, handsome and rich boys like her. Everyone one know that its not a big issue for a young girl to have boy friends in india. So why she gonna do that with a 45 year old servent, when everybody says that she have high standards and was good in so many things. Then why do she choosed a 45 year old servant for her sexual desire that was niether rich nor good looking.
3. Lets believe that girl was strange and she wanted to have sex with servant and before her murder she was in objectionable state with servant. So that evidence also make talwars innocent somehow, that they did it for honour killing, anger. U know they are doctors they can give a lot of psychological reasons for that and can easily get away from any kind of punishment. But they aren’t going with that as well.
4. If she was raped or having sex with servant, then her vaginal sample gonna prove it and that again in the favor of talwars. But her vaginal sample was completely, nobody can get those evidences now. and u see there are so many evidences and many are ruined but only her vaginal evidences were completely removed because that evidences gonna lead crime to the exact person who killed them. And only a doctor know that from some sexual evidences, u can get most of the information in such kind of sexual abuse murders.
5. Wide vaginal opening found on Aarushi’s body could have resulted only when someone manipulated it while the rigor mortis was setting in. This proved that she was sexually abused not before her murder but after her murder as well.
So, most of the time people talk about evidences that has been carrie dout from crime like bed sheets, pillows, whisky bottles, yeah those are important but most important one in this case is her vaginal evidences, when she have parents that have weird sexual fantasies. Nobody gonna talk about these evidences because not only talwar, but most of the doctors and high classes people (liberal like talwar’s, that have such weired sexual fantasies as well) gonna suffer not only by whole country, medi but also internationally. That is going to be very dangerous for indian medical profession that is most popular business in india and many foreigner come in india only for their medical treatment.
But the truth is that these two parents were involved in some kind of sexual activities with their own child, and not only father but also mother. That is why she is on the side of her husband, otherwise women are emotional they can easily go against her own husband for their children. But in this case mother was also involved in that act. And they must be doing it for the first time with her and which she didn’t want and when they forced her she must be shouted because of which servant came there and talwar has no other choice except killing both of them. Because in our society or perhaps in anywhere sexual abuse with ur own child is much more shameful than killing ur child.
Perhaps its honor killing, an honor killing to hide their gild, sin and shame.But the worst thing is that she must had been abused sexually by her parents after her death because thats what her vaginal evidences indicated about. And semen was removed from white fluid was found inside her during postmortem, because thats semen msut belongs to her own father nobody else.
And if u don’t believe in all of this just watch any of talwars interview, reporting, photos anything, if u are sensible, if u have family and a heart u can easily get it that they aren’t fighting for their child, they are fighting for themselves. They aren’t hiding grief of their child loss but some other kind of grief. Yes they looks sad, shocked but not because child is death because they were caught and serial murderers do plans for months only that how they have to pretend. but in this case its years now, with time their limit is over and everyone can see their faces and can easily say that they are culprits.
This is what I too suspect, because of which the parents prefer being in jail, than reveal the truth and go down in the eyes of the world; but I get angry and abusive hate messages from people who seem to know the family, or are carried off by explanations given by some writers in favour of the parents, whenever I write so !
An email by Aarushi to her father, admitting something that she had done, which she said she should not have done, but that she tried it because all her friends do it, suggests that she might be having sex with her boy friends, judging from the vaginal findings of a wide opening etc., and the way in which she was laid, with her pyjama having come down very low, which indicates manipulation probably by her parents.
It was mentioned in one report that a social worker who visited
Nupur Talwar after the incident, said that Nupur told her some
thing/s very pertinent and secret, but which she could not
tell because she was bound by the confidence Nupur had placed in her !
I think so this is the most mysterious case in the history of india… I hope so that may we see any clear evidence regarding this case. And i am really happy to see u usha mam that u can also feel that pain that i felt when i came to know about this case. And u are working on this case with so much intensity…. Hope so there will be some evidence that can give peace aarushi’s soul as well as our’s too…
Mam, After reading many articles it is clear that both the victims were hit by blunt object first and secondly by a sharp weapon. The first attacks were made may be when victims were not aware of being attacked. The second attacks were made with sharp weapon may be to not take any chance of any of them survive. I guess Hemraj’s murder attempt was first and Aarushi’s was later. May be killer/s murdered Hemraj on terrace and washed hands in the water near cooler and went down to flat and checked wheather anybody is awake. May be killer/s found aarushi’s door not locked and pressumed that Aarushi might have witness the killing of Hemraj. Not to take any chance killer/s went into Aarushi’s bedroom and hit her with a blunt object while she was in sleep. This might be the reason Aarushi could not get chance to confront and her bed was not disturbed either. Later Aarushi was hit with a sharp object. The killer/s might have also checked bedroom door of Mr & Mrs Talwar.
If killers thought Aarushi was witness to crime, then will they not be shocked to see she is sleeping with door unlocked?? If anyone has witnessed the crime, she will (out of fear) lock her door and then only sleep or better still, make a huge noise…The moment killers will see she is sleeping door unlocked, it would be clear to them, she was not witness to the crime.
Very informative. After watching movie ‘Talwar’ and reading many blogs, I am of the opinion that both murders were not planned.
1)Planned murdered won’t happen in the house, in presence of parents.
2)Planned murders won’t happen at mid-night in secured house.
3)If planned, murderers won’t keep Hemraj’s body on terrace.
All above three point indicate that murders were unplanned. and they happened in feat of rage.
Who could do these murders in feat of rage? Answer is obvious. Parents. Krishna didn’t. Recent Narco test video clearly confirms that. Dubious investigation by Arun Kumar was to save Talwars and put innocent servants behind bars.
Reasons for feat of rage ?. Many theories are there. My guess(may be completely false) is Aarushi was determined to reveal few things about her parents on internet and to her friends. Hemraj was also determined to reveal few things. Aarushi may had reveal few other things in the past too.
Imagine yourself in place of parents and then you get few guesses.(You kill the person in feat of rage when you think that opposite person is creating a challenge for your existence- Money or your social status. Here money was not an issue, at least from information i have.
As Madam mentioned in the article, Hemraj and Aarushi were alone at home in the afternoon on 15th. Hemraj won’t dare to enter into Aarushi’s room at night when parents are there in the house. So the assumption of Hemraj found in objectionable situation with Aarushi seems untrue. Further no child would expose their parent/s as bad when they know it may harm personally to him/her among friends/relatives. So this assumption also seems untrue. I guess murders were planned and unplanned as well. Aarushi’s murder seems to be unplanned and Hemraj’s was planned I guess. Hemraj had doubt that someone may kill him. If Hemraj had threat from Talvars, he might have left the job. Aarushi might been killed because her door was unlocked and killer may have thought that she might have seen the murder of Hemraj. Now who killed Hemraj!!! In the narco test video of Krishna, Krishna mentioned about a girl and Hemraj saying ” Hemraj ke haath ek ladki aaya hai jo 12th mein Hai”. Here the rage and planning etc can be assumed. Someone from that girl’s side may have developed rage against Hemraj. Also one other assumption can be made against ex-servant Vishnu. Hemraj had not taken his already served dinner at 10.30pm. Something may be wrong with Hemraj at that time I guess. While at the same time parents were with Aarushi and gifted her a camera. Also Aarushi took pictures as well around that time and talked with Anmol around 11.00pm. Hemraj alone was in danger I guess. I have very very less doubt on Mrs. Nupur. On 15th accidentally or intentionally Mrs. Nuper picked up Aarushi from school herself which was not generally done, later in the evening she switched off her mobile which was also not generally done and further Mrs. Nupur’s idea/suggestion to gift camera to Aarushi on that same night prior to Aarushi’s birthday on 24th.
Hmm. What about cleaning of private parts? Murderer(s) from outside won’t spare a time for doing this. I am sure cops must have talked to Anmol about his last conversation.

Again that somebody could easily hit Hemraj during day time. Entering somebody else house knowing that people are sleeping is highly unlikely. In most cases, generally somebody from that girl’s family could easily give 4/5 slaps to Hemraj outside Talwar’s house and complain to cops if Hemraj is adamant. Cops generally beat maids(that too Nepali origin) mercilessly and its known fact. So somebody from outside killing Hemraj is less.
As per Forensic expert Dr. Sharma, Aarushi’s post mortem report do not show signs of injuries in case of her private parts. Also he had given good details of type of fracture on Aarushi’s head. Must read it… Hemraj’s room condition and liquor & sprite bottles suggest possibility of other peoples’ presence at house at the night of 15th and 16th. ONE CAN ONLY ASSUME AND DERIVE PROBABILITY OF PEOPLE INVOLVED IN THIS MURDERS BECAUSE THERE ARE NO EVIDENCE FOUND TILL DATE AND JUDGEMENT IS BASED ON CIRCUMSTANCES. We can only assume and try to figure out chances of who are involved. We cannot blame directly.
I agree. Imagine yourself in position of Hemraj. You have invited your friends at night and they are drunk. One of them tries to assault the girl. Would you not knock the parent’s door immediately? so that you know you will get quick help ?Or won’t you shout loudly if you can’t physically beat them ?Also drunken men sexually assaulting is understood but murdering two people, that two one of them(Hemraj) is physically well built is unlikely. If the person is drunk, no matter how is physique is, anybody who is not drunk, can easily given 5 slaps and make him collapse and overpower them.
So outsiders came, drunk, assault Aarushi and then murder her and Hemraj… and then locking the terrace and running out without security guys unaware…. appears highly unlikely… to me.

This theory has some weights, for the fact that Hemraj was threatened to be killed some days prior to the murder and that he even run to the social activitist for help. Is it possible that Hemraj had a kind of a ‘relation’ with this girl in the 12th class and her famiy or brother got to know about it. Perhaps this girl ‘s servant, brother, cousin whatever were friends of Hemraj and used to visit him in his room. Hemraj getting his last call from a pco in Nithari indicates probably killer was somewhere living in this area. Girl was in the 12th class, perhaps coming from a middel class familly as well.
Worth reading. Just saw movie talwars and bow hunting out wat went wrong. Are they the real culprits or not??
I don’t think either of them has directly committed the murder, but
I am not sure that Rajesh Talwar knows nothing about who the culprit is, as it is assumed to be some well built man with large foot size, and close to the family. I think their driver Umesh Sharma, who from the photographs that appeared in the Press at that time, was a tall man, has done it at Rajesh’s behest, but perhaps on his own for his personal reasons. His finger prints have not been taken though, by the Police or CBI, for whatever reason.
The real target was only Hemraj, the servant, for gossiping too much about the Talwar family and those related to them, but Aarushi happened to come there when the murder was committed, so she too was killed for becoming a witness of the crime, though it was not planned. However, it is felt that Rajesh was knowing about the crime and the criminal, as it was probably done to save his family honour; hence he cannot expose his driver, but has to cover up for him. It’s a case of ‘Apne hi Daant, Apne hi Honth’!
I think that we will never get an answer to this murder mystery UNLESS the CBI Special Court at Ghaziabad or Allahabad High Court, or the Supreme Court orders the
proper interrogation and subjection to all the grilling tests, esp. matching of Finger prints and DNA on the forensic samples – applied to the Talwars and the three servant suspects – to the Talwars’ Driver Umesh Sharma, Rajesh Talwar’s brother Dinesh, and Aarushi’s latest boyfriend, Anmol Agarwal, which the Noida&UP Police as well as the
CBI are apparently deliberately avoiding, for reasons best known to them. Anmol’s father, who is said to be a Govt. officer must have managed to extricate his son from the investigation using his influence on the grounds of his minor age at the time of the murders. So also Umesh must be being saved by Dinesh Talwar for preventing the Driver, who is possibly the chief murderer, from revealing the names of his accomplices, whoever they may be, including perhaps one of the persons in the flat of the neighbour of the Talwars too – either the owner or his servant Vijay Mandal, considering that the trail of someone’s bloodstained shoes extended upto his door on the lower floor, though he denies it.
Rajesh and Nupur Talwar got justice at last, but poor Aarushi and (poor?) Hemraj Did Not!
They should appoint a private detective!
So what is the next step. I don’t live in India, but in USA…but after reading about this a lot. I want justice specially for a minor girl Aarushi…Hemraj too but at least he lived for 45 years, but this girl did not even able to see this world…I am also very angry why the general people of India are not pleading or demanding the government and Mr. Modi to do some proper investigation.
